NOTICE OF ADOPTION OF AN ORDINANCE ESTABLISHING PAYMENT TERMS AND ADMINISTRATIVE REMEDIES FOR FAILURE TO PAY WATER AND/OR SEWER FEES IN THE TOWN OF MEDORA, INDIANA

ORDINANCE NO. 2026 – 1

Taxpayers, property owners, and other interested parties in the Town of Medora, Indiana (“Town”) are hereby notified that the Town Council adopted an ordinance establishing payment terms and administrative remedies for failure to pay water and/or sewer fees on March 9, 2026.  The ordinance sets the fees for failure to pay and amends the date that payments are due.  The effective date of the ordinance is March 9, 2026.

Section 1.

(A) All water and sewer charges are due on the fifteenth (15th) day of each month; if the fifteenth (15th) day falls on a weekend or a holiday, it shall be due on the next business day.

(B) When a resident-user (“user”) fails to pay its water and/or sewer fees when due, the Town may fine such user in an amount not to exceed five dollars ($5.00) for every month that remains unpaid.  Such fines shall be considered on an individual basis.

(C) Unpaid charges, fines, and penalties shall, after 60 calendar days, be assessed an additional penalty of 10% of the unpaid balance, and interest shall accrue thereafter at a rate of 0.5% per month.  A lien against the user’s real property shall be sought for unpaid charges, fines, and penalties.

(D) If payment for water service is not received by the second (2nd) day of the subsequent month after payment is due, the user’s water service shall be disconnected at 10:00 AM.  In the event the second (2nd) day of the month falls on a weekend or a holiday, the disconnection shall occur on the next business day at 10:00 AM. 

(E) The user’s account must be paid in full, with an additional $45.00 reconnection fee, for water service to be reconnected. 

(F) Users desiring to dispute fines must file a written request for the Town to reconsider the fine along with full payment of the fine amount within 30 days of being notified of the fine.  Where a request has merit, the Town may convene a hearing on the matter.  In the event the user’s appeal is successful, the payment shall be returned to the user.  The Town may add the costs of preparing administrative enforcement actions, such as notices and orders, to the fine. 

(G) Users shall be responsible for all attorneys’ fees and litigation costs resulting from the Town’s collection efforts.  

(H) Issuance of an administrative fine shall not be a bar against, or a prerequisite for, taking any other action against the user.

ADOPTED BY THE TOWN COUNCIL this 9th day of March, 2026.
