NOTICE OF ADOPTION OF A DECLARATORY RESOLUTION BY THE JACKSON COUNTY REDEVELOPMENT COMMISSION AND OF A PUBLIC HEARING WITH RESPECT THERETO

Notice is hereby given that the Jackson County Redevelopment Commission (the “Commission”), being the governing body of the Jackson County Department of Redevelopment, on December 27, 2023, adopted a resolution (the “Declaratory Resolution”), making certain proposed amendments to the declaratory resolution previously adopted by the Commission which established the Jackson County Economic Development Area No. 2 and designated a portion of such area as a separate allocation for the purpose of allocation and distribution of certain property taxes (commonly referred to as “tax increment”) under IC 36-7-14-39, known as “EDA No. 2 – Allocation Area No. 3” (such amendments, the “Amendments”). The Amendments designate Archaea Operating LLC, Archaea CCS, LLC, Archaea EPC, LLC, any affiliates of such company and their respective successors and assigns, and any equipment lessors of such entities, as “designated taxpayers” for purposes of IC 36-7-14-39.3, with respect to EDA No. 2 – Allocation Area No. 3.

Notice is hereby given that the Commission will conduct a public hearing on April 2, 2024 at 6:00 p.m., local time, in the new meeting room at the Jackson County Courthouse, located at 111 South Main Street, Brownstown, Indiana, to receive and hear remonstrances and objections from all persons interested in or affected by the proposed Amendments. At the public hearing, the Commission will also determine whether the proposed Amendments are reasonable and appropriate when considered in relation to the original plan and the purposes of IC 36-7-14, and whether the plan, with the proposed Amendments, conforms to the plan of development for the County.

NOTICE OF ADOPTION OF PRELIMINARY DETERMINATION

Notice is hereby given to the taxpayers of the City of Austin, Indiana (the “City”) that the Common Council of the City (the “Council”) did, on March 12, 2024, make a preliminary determination for the Council to approve the City entering into a lease with the Austin Building Corporation, which is a nonprofit building corporation (the “Building Corporation”), for the purpose of assisting the Building Corporation with financing all or a portion of the construction, installation, and/or acquisition of certain photovoltaic solar energy arrays to serve the City’s wastewater treatment plant (the “Project”). The proposed term of the Lease Agreement with the Building Corporation, dated as of March 12, 2024 and including any addendums subsequently entered into between the City and the Building Corporation (collectively, the “Lease”), will not exceed twenty (20) years after the Leased Premises (as defined in the Lease) are completed and ready for use. The Building Corporation will finance the costs of the Project, together with any costs of issuance, capitalized interest, and a debt service reserve associated therewith, through the issuance of one or more series of Lease Rental Revenue Bonds (the “Bonds”) in an aggregate principal amount not to exceed $4,500,000 and with a maximum term of twenty (20) years, which will be secured by the semi-annual lease rental payments due under the Lease. The interest rate on the Bonds will not exceed 8.00% per annum.

The lease rental payments owed by the City under the Lease are payable from all legally available revenues of the City. The Lease further provides for terms concerning the use, maintenance, repair, operating and utility costs, indemnification and insurance, destruction of the Leased Premises, defaults, remedies, option to purchase, and other miscellaneous matters.

Notice is hereby given that the City of Austin, Indiana (the “City”), has executed a lease, dated as of March 12, 2024 (the “Lease”), between the Austin Building Corporation (the “Building Corporation”), as lessor, and the City, as lessee. After a public hearing on the proposed Lease held by the Common Council of the City (the “Council”) on March 12, 2024, at which all interested parties were provided the opportunity to be heard, the Council adopted an ordinance which, among other things, authorized and directed the City officials to execute and deliver the Lease, in substantially final form as presented at the meeting, and found that the rental payments to be paid by the City are fair and reasonable and that the use of the Project throughout the term of the Lease will serve the public purpose of the City and is in the best interests of its residents. The Building Corporation adopted a resolution on March 12, 2024 approving and authorizing the execution of the Lease. The rental payments due under the Lease will be payable at a rate not to exceed $450,000 per year in semiannual installments plus an amount not to exceed $5,000 annually for Trustee and other administrative fees. The term of the Lease will begin on the date that the Premises are completed and ready for use and will end on a date not later than twenty (20) years thereafter. The Lease further provides for terms concerning the use, maintenance, repair, indemnification and insurance, destruction of the premises, defaults, remedies, option to purchase, and other miscellaneous matters. The Lease is open to public inspection by the public during normal business hours, at the office of the City Clerk-Treasurer, located at 80 West Main Street, Austin, Indiana 47102.

Notice is hereby given, that the Stucker Fork Conservancy District, hereinafter referred to as the Owner, will receive sealed bid packets for the Repainting of the 100,000 Gallon Elevated Tank No. 2 (Little York) and the 100,000 Gallon Elevated Tank No. 4 (Commiskey).

Sealed bids are invited and must be received by the Owner at Stucker Fork Conservancy District, 2260 U.S. Highway 31, Austin, IN 47102, no later than 2:00 P.M. Eastern (local time) on April 11, 2024. If bids are forwarded by mail, the sealed envelope must be enclosed in another envelope addressed to the Owner at P.O. Box 274, Scottsburg, IN 47170. Bids received after such hour will be returned unopened. The work to be performed and the bid to be submitted shall include sufficient and proper sums for all general construction, mechanical installation, labor, materials, permits, licenses, insurance, and so forth incidental to and required for the

construction of the facilities.

Each bid must be enclosed in a sealed envelope bearing the title of the Project and the name and address of Bidder. All bids must be submitted on the bid forms as identified in the Contract Documents and Specifications.

Each bid shall be accompanied by a certified check or acceptable bidder’s bond made payable to the Owner, in a sum of not less than five percent (5%) of the total amount of the highest aggregate bid, which check or bond will be held by the Owner as evidence that the bidder will, if awarded the contract, enter into the same with the Owner upon notification from him to do so within ten (10) days of said notification. Bidders bond must include a certified copy of the power of attorney.

Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. The bonds will be in the amount of 100% of the Contract Price and must be in full force and effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion.

Bid security of the three lowest Bidders will be retained until the Contract has been awarded and executed, but no longer than ninety (90) days from the date of opening Bids. The Owner reserves the right to reject any bid, or all bids, or to accept any bid or bids, or to make such combination of bids as may seem desirable, and to waive any and all informalities in bidding. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bid may be withdrawn after the scheduled closing time for receipt of bids for at least ninety (90) days.

A conditional or qualified Bid will not be accepted. Award will be made to the low, responsive, responsible bidder.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Bids shall be properly and completely executed on bid forms included in the Specifications. Bids shall include all information requested by Indiana Form 96 (Revised 2013) included with the Specifications. Under Section III of Form 96, the Bidder shall submit a financial statement. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.

Each Bidder is responsible for inspecting the Project site(s) and for reading and being thoroughly familiar with the Contract Documents and Specifications. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid.
