Notice of Public Hearing By Austin Redevelopment Commission

(Relating to Austin Economic Development Area No. 1)

Notice is hereby given that the Austin Redevelopment Commission (the “Commission”) will conduct a public hearing on Wednesday, January 24, 2024, at 8:00 a.m., local time, at the Austin City Hall, 80 West Main Street, in Austin, Indiana, to consider proposed amendments to the resolutions previously adopted by the Commission and subsequently amended that established the Austin Economic Development Area No. 1 (the “Economic Development Area”) and adopted an economic development plan for the Economic Development Area. The proposed amendments, which have been preliminarily approved by resolution of the Commission, would (a) expand the existing Economic Development Area to include certain additional parcels, (b) designate certain parcels as a separate new allocation area to be known as the “City of Austin Allocation Area No. 2,” and (c) expand the list of permissible projects in the

Economic Development Area, as so expanded, to include certain additional projects and purposes ((a) through (c) collectively, the “Amendments”).

NOTICE OF ADOPTION OF AN ORDINANCE REGARDING USE OF RECREATIONAL VEHICLES IN THE TOWN OF CROTHERSVILLE, INDIANA

Taxpayers, property owners, and other interested parties in the Town of Crothersville, Indiana are hereby notified that the Town Council adopted an ordinance regarding use of recreational vehicles in the Town of Crothersville. The effective date of the ordinance is January 3, 2024.

ORDINANCE NO. 2023 – 8

AN ORDINANCE REGARDING USE OF RECREATIONAL VEHICLES IN THE TOWN OF CROTHERSVILLE, INDIANA

WHEREAS, the Town Council for the Town of Crothersville, Indiana (“Town”) finds it necessary and prudent to adopt an ordinance regarding the use of recreational vehicles in the Town of Crothersville, Indiana; and

NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CROTHERSVILLE, INDIANA:

1. Storage or parking of recreational vehicles is subject to the following conditions:

a. At no time may anyone occupy or use a parked or stored recreational vehicle for living, sleeping, or housekeeping purposes, except as outlined below.

b. A property owner may allow a recreational vehicle to park on the owner’s property for up to fifteen (15) consecutive days, but not to exceed thirty (30) total days in any one calendar year to allow a visit by the recreational vehicle’s occupant.

(i) Exceptions may be made on a case-by-case basis with permission from the Town Council.

c. No more than one recreational vehicle may be stored or parked outdoors on a residential parcel at any one time.

d. A recreational vehicle shall not be parked on a parcel without a primary building.

e. The owner of a recreational vehicle may store or park their unoccupied recreational vehicle behind or alongside the primary building in such a manner that no part of the vehicle projects beyond the front of the primary structure.

f. A recreational vehicle shall not block a sidewalk.

g. A recreational vehicle shall not be used for personal storage.

h. No permanent structure may be erected or used on any parcel for use with the occupancy of a recreational vehicle, such as porches or storage sheds, or any other structure based around the recreational vehicle.

i. “Recreational vehicle” shall include RVs, campers, travel trailers or any other towable trailer or vehicle used for recreational purposes.

2. Any person in violation of the provisions of this section will have twenty-four (24) hours to remove such recreational vehicle once notified of the violation.  Failure to do so will subject the individual to the fines and penalties as specified by this ordinance.

3. Penalties shall range from a minimum of fifty dollars ($50.00) per day to the statutory maximum of $2,500.00 per day, and may apply to the owner of the recreational vehicle as well as to the real property owner, if the owner is permitting storage or parking in violation of this ordinance. Penalties may also include towing of the offending recreational vehicle; fines shall still accrue after being towed and while in possession of the Town or towing entity, until collected by the owner or other authorized party.

4. All other provisions of the Town Code not modified by this ordinance shall remain in full force and effect.

5. This Ordinance shall be in effect from and after its passage by the Town Council in accordance with law.

ADVERTISEMENT FOR BIDS

Notice is hereby given that sealed bids will be received by the Austin Parks Board, Austin, Indiana for the “AUSTIN BROADWAY PARK IMPROVEMENTS” project. Sealed bids will be received until 2:00 p.m. local time on the 7th day of February 2024, by the Austin Parks Board, 80 West Main Street, Austin, IN 47102. Bids received after such hour will be returned unopened and shall not be considered. Federal Land and Water Conservation Fund monies will be used to assist in the park improvements and all relevant Federal and State Requirements and Provisions will apply. Build America, Buy America is a component of the Federal Requirements. All 2010 ADA Standards and Architectural Barriers Act standards and guidelines apply, as well as all ABA regulations. For all LWCF grants involving federally assisted construction contracts and subcontracts in excess of

$10,000, the recipient must comply with Executive Order 11246, as amended, and with the regulations of the Office of Federal Contract Compliance Programs of the Department of Labor at 41

C.F.R. Part 60-4 (https://www.ecfr.gov/current/title-41/subtitle-B/chapter-60/part-60-4). Goals for minority participation is 9.6% and goals for female participation is 6.9%. The LWCF program is not subject to the Davis Bacon Act, so contractors are not bound to construction wage rates established by the US Department of Labor (unless other federal funds are used as local match).

This park improvements projects involves the installation of the following:

•Installation of 4,080 SF of poured in place playground surface at existing playground.

•Installation of a 1,745 SF toddler play area.

•Installation of a 1,256 SF splash pad

•Installation of tennis court and skate park.

•Renovate existing maintenance building for restroom improvements and concession area.

•Installation of bollard solar lights around existing trail and overhead solar lights.

•Installation of underground electric service and removal of all overhead electric services.

•Installation of park entrance signage.

•Alternate 1- Installation of 2,240 LF of 8’ wide stone path.

•Alternate 2 – Installation of a 9-hole frisbee golf course.

The Owner reserves the right to reject any proposal, or all proposals, or to accept any proposal or proposals, or to make such combination of proposals as may seem desirable, and to waive any and all informalities in bidding. Award will be made to the lowest, responsive, responsible bidder. The low, responsive and responsible bidder must not be debarred, suspended, or otherwise be excluded from or ineligible for participation in federally assisted programs under Executive Order 12549. No proposal may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days. A conditional or qualified Bid will not be accepted.

The bidder must file with their sealed bid proposal, a certified check or a bid bond in the amount equal to ten (10) percent of the total bid, payable to the Austin Parks Board. The above check or bond is to ensure the execution of the contract on which such bid is made.

The qualified Contractor to whom the work is awarded shall furnish, within ten (10) days after the date of said contract award and before commencing work, a performance and payment bond in an amount equal to the bid price of the contract awarded to said contractor, and certificates of all insurance required by the Specifications.

Bids shall be properly and completely executed on bid forms included in the Specifications. Bids shall include all information requested by Indiana Form 96 included with the Specifications. Under Section III of Form 96, the Bidder shall submit a financial statement. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.

The bidder must file with their sealed bid, a certified check or bid bond in the amount equal to ten (10%) percent of the total bid, payable to the Jackson County Board of Commissioners. The above check or bid bond is to ensure the execution of the contract on which such bid is made.

The contractor to whom the work is awarded will be required to furnish, before commencing work, a performance, maintenance and payment, bond in the amount equal to the bid price of the contract awarded to said contractor, and certificates of all insurance required by specifications.
