NOTICE OF EXECUTION AND APPROVAL OF LEASE BETWEEN THE AUSTIN REDEVELOPMENT COMMISSION AND THE AUSTIN REDEVELOPMENT AUTHORITY

Pursuant to action taken by the Austin Redevelopment Commission (the “Commission”) and the Austin Redevelopment Authority (the “Authority”) on May 25, 2022, each approved a Lease Agreement (the “Lease”) between the Commission and the Authority to be effective as of May 25, 2022. The City of Austin Common Council has approved the Lease by Resolution adopted on May 19, 2022.  The Lease covers the Leased Premises (as defined in the Lease) in the Austin Economic Development Area No. 1 (formerly known as the Austin Economic Development Area). The Lease is for a term not to exceed twenty (20) years and shall be payable from Tax Increment (as defined in the Lease), and, to the extent Tax Increment is not sufficient, from a special benefits tax levied on all of the taxable property in the Austin Redevelopment District (the “District”).  A copy of the Lease is on file in the office of the Austin Clerk-Treasurer at 80 West Main Street, Austin, Indiana and is available for inspection during normal business hours.

REGARDING DETERMINATION

AUSTIN REDEVELOPMENT AUTHORITY

The taxpayers of the City of Austin, Indiana (the “City”) are hereby given notice that the Redevelopment Authority (the “Authority”) of the City determined, at its meeting held May 25, 2022, to issue its Lease Rental Revenue Bonds of 2022 in an amount not to exceed $4,000,000 (the “Bonds”).  The proceeds of the Bonds will be used for (i) construction of a building for the City’s Police Department; (ii) utility and infrastructure improvements to support certain housing developments and businesses; (iii) expansion of Dowling Road; (iv) new infrastructure for City Hall; (v) physical education equipment for Scott School District 1; (vi) certain matching grant funds; and (vii) payment of costs of issuance for the Bonds. The proposed Bonds will have a final maturity of no later than January 15, 2040. The Bonds will bear interest at a rate or rates not exceeding four and one half percent (4.50%) per annum, the exact rate or rates to be determined by a negotiated sale. The Bonds will be payable from real property tax proceeds from assessed valuation in the Austin Economic Development Area No. 1 (formerly known as the Austin Economic Development Area) in excess of the assessed valuation described in Indiana Code 36-7-14-39(b)(1), as such statutory provisions exist as of May 25, 2022 (“Tax Increment”), and, to the extent Tax Increment is not sufficient, from a special benefits tax levied on all of the taxable property in the Austin Redevelopment District.

No bid may be withdrawn after the scheduled closing time for receipt of bids for at least ninety (90) days. A conditional or qualified Bid will not be accepted.

Award will be made to the low, responsive, responsible bidder.

The project is being financed in part by the Indiana Finance Authority State Water Infrastructure Fund (SWIF). Contractors and subcontractors are notified that they are required to pay not less than the prevailing wage rates established by the U.S. Department of Labor and the Davis-Bacon Act. Said wage scale is included in the project Specifications.

Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. The bonds will be in the amount of 100% of the Contract Price and must be in effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Legal Notice of Public Hearing

Notice is hereby given that the Scott County Board of Zoning Appeals will hold a public hearing at the Scott County Courthouse 1 E. McClain Avenue, Room 128, Scottsburg, IN on Wednesday, June 8, 2022, at 6:00 PM at which time all interested persons will be given the opportunity to be heard in reference to the matters set out in the “Description of Action Requested” below:

Description of Action Requested: Applicants request granting of a Variance from the Scott County Zoning Ordinance’s Standard of allowing only four (4) splits from a single piece of property. Of the 11 total splits on the original, configured property, three (3) occurred before adoption of said Standard and thus “grandfathered.” None of these nor a fourth split are owned by applicants. Of the seven (7) platted by applicants, one (1) has a house original to original configured property. Five (5) platted lots rely/will rely on county roads for ingress/egress. Two (2) platted lots will have ingress/egress on private easement road.

Description of Property Affected: Parcel No. 72-02-22-200-007.000-004 cka 2027 East Harrod Road, Austin, IN 47102, and containing 30 acres.

Reasons necessitating the Request: Property is uniquely positioned at the corner of two county roads, which will provide ingress/egress for residents of four (4) of six (6) planned homes on lots with more than County Standard of 2.00 acres. Planned easement road will serve only two (2) lots.

Reasons Necessitating Request: Owners do not require or need a larger home than what a pre-built structure will provide, which will be 576 sq. ft. or larger with a porch. They will be modifying the structure and bringing electrical wiring and plumbing up to code and adding insulation to allow for safe, comfortable, all-season living.
