Jackson County Water Utility to obtain assistance from the Drinking Water State Revolving Fund (DWSRF) Loan Program for Drinking Water Utility Improvements
The Jackson County Water Utility will hold a public hearing at 7:30 pm on Thursday, July 8, 2021 at the Jackson County Water Utility office located at 1119 W. Spring Street, Brownstown, IN 47220. The Utility’s engineering consultant, Curry & Associates, Inc., will present the recommended improvements which includes replacement of certain water mains in Brownstown and removal of lead service line connections along those water mains as described in the Preliminary Engineering Report (PER). The project will be funded through a DWSRF loan.
At this hearing, there will be the opportunity for questions and comments from the public. If special assistance is required at the meeting, please contact Larry McIntosh, Utility General Manager, at 812-358-3654. Copies of the PER are available for public viewing starting June 28, 2021 at the Jackson County Water Utility Office, located at 1119 W. Spring Street, Brownstown, IN 47220. LEGAL NOTICE
COMMON COUNCIL OF THE CITY OF SCOTTSBURG, INDIANA
ORDINANCE NO. 2021-12
AN ORDINANCE TO ESTABLISH A CONTRACTOR REGISTRATION PROGRAM
WHEREAS, the Common Council of the City of Scottsburg (the “Council”) finds that it is reasonable and necessary to promote and accommodate the orderly development and to protect the public health, safety and general welfare of the citizens of the City of Scottsburg (the “City”) by providing for an equitable registration program for contractors who intend to perform work on residences and/or businesses within the City’s planning and zoning jurisdiction; and
WHEREAS, the Council further finds that it is reasonable and necessary to promote the orderly construction process of the City by establishing standards by which the City may require registration for contractors who intend to perform work on residences and/or businesses within the City’s jurisdiction; and
WHEREAS, the Council further finds that in order to provide a service for the public good and for its citizens in the interest of public welfare and protection of investment require that all permit applicants must be registered with the City prior to obtaining permits; and
WHEREAS, the purpose of this ordinance is declared not to hinder or deter business relationships or opportunities within the City, but rather to protect the health, safety and welfare of its residents.
THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SCOTTSBURG as follows:
Section 1: Registration Requirements. This ordinance does hereby establish registration requirements for contractors seeking to perform work on residences and businesses located in the City of Scottsburg. To become a Registered Contractor with the City, the applicant must complete a Contractor Registration Application and must also provide the following:
A. A certificate of insurance indicating coverage of a minimum of $500,000 for each occurrence of death or bodily injury, minimum of $100,000 for each occurrence of property damage, or must have combined single limit coverage which covers both bodily injury and property damage, with a minimum of $500,000 per occurrence. The certificate shall indicate the policy number, effective and expiration dates of the policy, the name of the insured, contact information for the insurance agent, and the coverage shall not be limited to a single job.
B. Contractor shall notify the Executive Director of the Plan Commission of any insurance changes or cancellations within ten days of occurrence. Failure to do so may be a basis for the revocation of a contractor’s registration.
Section 2: Term of Registration. All issued Contractor Registrations shall be valid for one year from the date of issuance.
Section 3: Exceptions. The following exceptions to the Contractor Registration process shall apply:
A. Homeowners applying for required residential permits who intend on performing all work themselves, shall not be required to be registered as a contractor to obtain residential permits; and
B. Change of Use and or Occupancy permit applicants need not be registered to obtain required permits.
Section 4: Violation/Penalty. In the event a contractor fails to obtain the necessary and required permits or respond to noticed violations by the City or comply with the requirements set out above, the City reserves the right to suspend and/or refuse approval/renewal of Contractor Registration until such time that the Contractor demonstrates compliance as determined by the City Building Inspector or his/her designee. Failure to comply with this Ordinance by (a) failing to obtain a license before commencing any construction activities, or, (b) failing to maintain the required policies of insurance as set out above during the term of the license is a violation of this Ordinance which shall subject the offender to a fine of $50 for the first offense, $250 for the second, and $2,500 for any subsequent offenses. Any violator may appeal the issuance of a fine by filing a written appeal with the Board of Works and Public Safety. The Board shall set a hearing on the matter and provide notice to the violator of said hearing at least ten days before said hearing. At the hearing, the violator may present evidence in defense of the fine. The Board shall make a final ruling on the issuance of the fine.
Section 5: City Assumes No Liability. The purpose of this Ordinance is set out above. By enacting this Ordinance, the City does not in any manner insure or warrant the competency of the Contractors licensed or the quality of the work performed by the Contractors licensed. No representations should be made explicitly by Licensed Contractors to the effect that licensure is a representation by the City of their competency or the quality of their work, nor should any property owner believe by inference that licensure is an endorsement by the City of the competency or quality of the work.
Section 6: No Conflict. All ordinances, resolutions, and orders (or parts thereof) that conflict with the provisions of this Ordinance hereby are repealed to the extent of such conflict.
Section 7: Severability. If any section, paragraph, or provision of this Ordinance is held to be invalid or unenforceable for any reason, then the invalidity or unenforceability of such section, paragraph, or provision shall not affect any of the remaining provisions of this Ordinance.
Section 8: Effectiveness. This Ordinance shall be in full force and effect from and after its passage and publication, as required by Indiana law.
