NOTICE OF ADOPTION OF AN ORDINANCE RESTRICTING SEMI-TRUCKS AND TRAILERS FROM USING CERTAIN ROADS AND STREETS IN THE TOWN OF CROTHERSVILLE, INDIANA
Taxpayers, property owners, and other interested parties in the Town of Crothersville, Indiana (“Town”) are hereby notified that the Town Council adopted an ordinance restricting semi-trucks and trailers from using certain roads and streets in the Town of Crothersville. The effective date of the ordinance is May 4, 2021.
ORDINANCE NO. 2021 – 3
AN ORDINANCE OF THE TOWN OF CROTHERSVILLE RESTRICTING
SEMI-TRUCKS AND TRAILERS FROM USING CERTAIN ROADS AND STREETS
WHEREAS, there now exists a need in the Town of Crothersville, Indiana (the “Town”), to restrict the use of certain roadways by semi-trucks and trailers in the Town; and
WHEREAS, the Town Council of Crothersville, Indiana, seeks to preserve and protect the real and personal property of its residents from semi-trucks and trailers driving through or over the residents’ real and/or personal property.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CROTHERSVILLE, AS FOLLOWS:
Section 1. Semi-Truck and Trailer. Shall include semi-trucks, with or without a trailer, which is operated for compensation or which is owned or operated by a private carrier for the transportation of property of which that person is the owner or bailee when that transportation is for the purpose of sale, lease, rent, or bailment, or in the furtherance of any commercial enterprise.
Section 2. Driving Restrictions. Semi-trucks, with or without trailer, weighing in excess of 10,000 pounds in declared gross weight, shall be restricted at all times to those streets and parts of streets designated as state highways, except that these vehicles may be operated on other streets solely for the purpose of either delivery or pick-up of materials or merchandise, and then only by entering upon streets not being state highways at the intersection nearest the destination of the vehicle and proceeding thereon no further than the nearest intersection thereafter; further, that these vehicles shall thereafter return by the nearest intersection, to the closest adjacent street designated as a state highway.
Section 3. Semi-trucks, with or without trailers, are prohibited on the following roads and streets within the corporate limits of the Town of Crothersville:
•E. Walnut Street from U.S. Hwy 31 to N. East Street
•E. Bard St. from U.S. Hwy 31 to N. East St.
•Dixon St. from U.S. Hwy 31 east to Seymour Rd.
•Dixon St. from U.S. Hwy 31 west to the Railroad
•S. Kovener St. from W. Howard St. to Industrial Way
•W. Howard St. from Park Ave. to Bethany Rd.
•N. Kovener St. from Myres St. to W. Walnut St.
•Marshall Dr. from U.S. 31 to Moore St.
Section 4. Semi-trucks, with or without trailers, weighing in excess of 10,000 pounds in declared gross weight, shall not be parked overnight upon any public street or other public way in this Town, provided that these vehicles may park where flat parking is permitted in the residential districts for a period of not more than one hour in duration.
Section 5. Any driver found to be in violation of this ordinance shall be cited and fined not less than $500.00, and shall be liable for replacement and repair of any damage to real or personal property.
Section 6. Permits. Any driver/owner of said trucks may apply with the Town for a permit to use any part of the prohibited roads and streets. The cost for an application shall be $100, and must state the purpose, the duration needed, and the location. If a permit is needed for longer than one (1) year, the holder must reapply and pay for a subsequent permit at the end of each year. The Town Police Chief and the Utility Superintendents must approve of the permit. Possession of a permit shall not relieve the driver/owner of any liability for damages caused to real or personal property.
Section 7. If any section, paragraph, clause, or phrase of this ordinance be declared unconstitutional or invalid, the remainder of said ordinance shall continue in full force and effect.
Section 8. All prior ordinances or parts thereof inconsistent with any provision of this ordinance are hereby repealed.
Section 9. This Ordinance shall be in full force and effect from and after its passage, and approval by the Town Council, all as by law provided.
ADOPTED BY THE TOWN COUNCIL this 4th day of May, 2021.

LEGAL NOTICE
REQUEST FOR PROPOSALS/QUALIFICATIONS
INFRASTRUCTURE TO SUPPORT HOUSING PROJECTS CITY OF AUSTIN, INDIANA
I. PROJECT INTRODUCTION:
In accordance with IC 5-23-5, the Redevelopment Commission for the City of Austin, Indiana (the “City”), invites any and all qualified parties to submit Proposals and Statements of Qualifications to develop new housing in the City, under which the City would consider requests for financial support to construct utility and road infrastructure to support the Project (the “Project”) under a public-private partnership. Although the full scope of the Project is not determined, the City has a clear need for additional housing. In order to facilitate the potential housing growth, the City is submitting this RFPQ to identify developers that are capable of scoping and developing housing. The purpose and intent of the Project is to fulfill essential economic development and quality of life goals for the City, and to meet the City’s obligation to provide safe road and utility infrastructure in a post- pandemic culture.
II. PROJECTSCOPE:
The selected proposer will provide all financing services, site procurement, development services, design services, site work, labor and material to develop and construct the Project. Proposers should include information on their proposed site (including information on how they will obtain the site if not already owned), a layout of the proposed housing and infrastructure on the site, a proposed phasing schedule, an overall budget for each phase (or average price per house), and a specific request as to what financial support is needed from the City for installation of utilities/infrastructure (i.e. – a description of the infrastructure and a proposed budget). Please note that the City will only consider requests related to public utilities and infrastructure and will not consider (nor is it legally capable of providing) financial support for the residences or lots. To the extent that any of the requested information is currently unavailable, please submit a proposal listing your qualifications and any information currently available, in which case the City may enter into a scoping period with the proposer to provide more time for the proposer to complete this information. Upon receiving a satisfactory proposal (or scoping period deliverables) from the selected proposer, the City will move forward with the Project and selected proposer via resolution or ordinance at a public hearing to complete the design, construction, and development of the infrastructure to support the proposed project. If (1) the selected proposer is unable to produce a satisfactory proposal or scoping period deliverables, or (2) the City determines that the Project is not necessary or wise, then the City will reject the proposer’s proposal or cancel this RFPQ process altogether. In either event, the resulting scoping period deliverables will be solely owned by the City, and the City may use the information from the scoping period deliverables for its future use and benefit.
III. PROPOSAL EVALUATION:
The City will review the proposals received. The criteria which will be utilized in evaluating proposals are as follows:
• Your experience developing similar projects
• Your demonstrated ability and capacity to perform the work, including your
reputation as indicated by your references for performing this type of work
• Your proposed site and development criteria
• The amount and type of support requested from the City
IV. PROPOSALS
Please respond to the following requests:
• A description of the project team
• Identify at least three (3) similar projects you have financed and developed.
• A proposed schedule for the Project, including proposed dates to start and complete construction and information on phasing of the Project.
• A proposed approach to the Project, including approximate sales costs, site plan, and design examples. Please also include information on whether the site is already owned by the proposer, or a plan on how the land will be acquired by the proposer.
• A succinct request as to the type and amount of financial support the proposer is requesting from the City for construction of road/utility infrastructure to support the Project.
V. General Conditions
It should be understood that:
• The City reserves the right to reject any and all Proposals/Statements of Qualifications at its sole discretion.
• The City does not require you to submit a certified check or other evidence of financial responsibility with your proposal other than the description of financing approach requested above.
• The amount of financial support requested from the City will be weighted equally with the proposer’s development approach and demonstrated qualifications by the selection committee when determining whether or not to move forward with the proposed project.
• All proposers will be accorded fair and equal treatment with respect to any opportunity for discussion and revision of proposals. The City may enter into discussions with proposers to clarify and assure a full understanding of proposals.
• The City may refuse to disclose the contents of the Proposals/Statement of Qualifications during discussions with eligible proposers.
• The construction of any infrastructure procured via this solicitation will be financed in partnership with the selected proposer under IC § 5-23, and therefore the Project will not utilize “public funds” as defined in IC § 5-22-2-23. Per both statutes, the selected proposer will not be subject to further procurement processes under IC § 36-1-12 or any other statute. However, the selected proposer will be required to provide a performance bond for 50% of the construction costs and a payment bond for 100% of construction costs per both IC § 5-23 and IC § 36-1-12.
• Proposing firms shall not contact City Common Council members, Austin Redevelopment Commission members, or any other public officials upon release of this RFPQ other than the RFPQ Committee’s representative (the “Representative”) listed below, unless authorized or directed to do so by the Representative.
