Kevin D. Polly, 57, of Rice Street in Austin was sentenced on June 15 in Scott Circuit Court to six years with in the Indiana Department of Corrections for dealing methamphetamine.
Officers with the Scott County Sheriff’s Office, through the use of a confidential informant, conducted controlled buys from Kevin Polly, in which he sold the informant methamphetamine, according to Scott County Prosecutor Chris Owens.
Polly entered into an open plea agreement. “An open plea is one in which the Judge determines the sentence so long as it is within the range of penalty allowed under the law for the level of crime for which the defendant pleads guilty,” explained Owens.
On Thursday, June 15, a sentencing hearing was held in which both the State and the defense presented arguments to the Court. After the hearing, Judge Jason Mount pronounced the sentence of six years all to be served in prison. Mount noted that Polly had previously been convicted of a dealing offense, which was a primary factor in determining the sentence.
Owens thanked the Scott County Sheriff’s Office for their efforts that led to this sentence and Deputy Prosecutor Mark Kiesler for his work in obtaining the conviction and sentence.
