Scottsburg City Board of Zoning Appeals tabled a decision on zoning variances for new home construction in Vienna during their meeting on Monday, Aug. 21.
Legacy Village is a residential project planned for a 30-acre parcel at 2693 South Vienna Road at the corner of Vienna Road and Highway 356 south of Scottsburg. While the community of Vienna is not in the city limits of Scottsburg, it does fall within the two-mile fringe area outside the city limits which is a part the city’s development jurisdiction.
The Scottsburg City Council denied the property’s rezoning in May from agriculture to residential due to Vienna residents’ objections.
The developers, Jeff and Jerry Mills are seeking zoning variances of 50 feet with 150 to 200 feet of road frontage for three lots, said Board of Zoning chair Josh Schulze.
Carmen Boley, Executive Director of the Advisory Plan Commission, said that this would create three lots out of the 30 acre parcel and that the developers met all the requirements to build on the property for the agriculture zoning.
Residents of Vienna spoke of their concerns about underground gas tanks that are on the property. Jerry Mills said that the removal of the tanks would start on Sept. 5.
The tanks do not affect the three lots that are in question for the requested variance, Schulze said.
Vienna Resident Robin Smith said that the developers had plenty of space on the 30 acres to have multiple lots with road frontage but didn’t see a reason for only doing the three to four lots.
The board zoning tabled and decision on the variances for Legacy Village until their next meeting on Sept. 18.
