On or about March 8, 2019 the above named City of Austin will request the State of Indiana to release federal funds under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383) for the following project:
Austin Wastewater Improvements Project
The City of Austin will focus on specific components of the wastewater system that need to be rehabilitated in order to address sanitary sewer overflows resulting in Notices of Violation from the Indiana Department of Environmental Management (IDEM). The project will include increasing the capacity of their Lift Station 1 by replacing pumps with higher capacity units to improve system reliability, and increasing the hydraulic capacity of the oxidation ditch splitter box and the clarifier splitter box. Increasing the capacity of these components will increase efficiency and improve the operation of the sanitary sewer system. Improvements will include grating and handrail access stairs to facilitate operation and maintenance of the system. Also included in the project is the construction of a phosphorous chemical storage facility which will house the storage tank and chemical feed lines to meet the new phosphorous limit. The outcomes of this project will be a 90 to 100% reduction of the sanitary system sewer overflows in the areas where 84% of the overflows have occurred and bring the city’s wastewater treatment system back into compliance with IDEM and the NPDES permit.

Finding of No Significant Impact
It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above named City of Austin has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (P.L. 91-190). The reasons for such decision not to prepare such statement are as follows:
All preliminary environmental reviews by state and county agencies indicated that the proposed project would not endanger the environment under any capacity.
An Environmental Review Record respecting the proposed project has been made by the above named City of Austin which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required. This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at the City of Austin, Clerk Treasurer’s Office, 82 Main Street, Austin, IN 47102. No further environmental review of such project is proposed to be conducted prior to the request for release of funds.
Public Comments of Findings
All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for consideration by the City of Austin, 82 Main Street, Austin, IN 47102. Such written comments should be received before March 7, 2019. All such comments so received will be considered and the City of Austin will not request the release of federal funds or take any administrative action on the proposed project prior to the date specified in the preceding sentences.
Release of Funds
The City of Austin will undertake the project described above with Community Development Block Grant funds from the State of Indiana under Title I of the Housing and Community Development Act of 1974. The City of Austin is certifying to the State that the City of Austin and Dillo Bush, in his official capacity as Mayor of Austin, IN consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the City of Austin may use the Block Grant funds and the State will have satisfied its responsibilities under the National Environmental Policy Act of 1969.
Objections to State Release of Funds
The State will accept an objection to its approval only if it is on one of the following basis: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by the State; or (b) that the applicant’s environmental review record for the project indicated omission of a required review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to the State of Indiana, Indiana Office of Community and Rural Affairs, Environmental Officer, One North Capitol, Suite 600, Indianapolis, Indiana 46204-2288.
Objections to the release of funds on basis other that those stated above will not be considered by the State. No objections received after March 24, 2019 will be considered by the State.

Notice of Explanation of Project Located In a Floodplain/Wetland
This is to give notice that the City of Austin has conducted an evaluation as required by Executive Order (11988 or 11990) in accordance with HUD regulations at 24 CFR 55.20 to determine the potential affect that its activity in the floodplain or wetland will have on the environment. The City of Austin has determined that there is not a practicable alternative other than locating the proposed Community Development Block Grant project described below in a floodplain/wetland.
The City of Austin’s proposed project impacting the floodplain is the Wastewater System Improvements project. The Project includes improvements to Lift Station No. 1 situated on a 0.13 acre parcel of land located on the south side of York Road diagonal to the west from the intersection of Plum Street and York Road. This location is the portion of the project which is within the flood plain. Improvements to Lift Station No. 1 consist of the replacement of the three (3) existing pumps with new, higher capacity units and upgrading the pump controls to accommodate the large pumps. The new pumps will be controlled by variable frequency drives to increase the efficiency of the station and reduce overall power costs. The new control panel will be housed in weather proof structure to improve the system reliability and facilitate maintenance. Note the lift station is already located within the floodplain in an elevated area and is not anticipated to further impact the floodplain. All proposed improvements will either be located below ground (the new pumps will be installed in the existing wet well, below grade) or replace existing structures (the existing above ground control panel will be removed and replaced with the new panel). The improvements will allow Lift Station No. 1 to pump additional flows and eliminate sanitary sewer overflows in this area. The proposed construction could impact approximately .13 acres of floodway.
The improvements must be located in the floodplain based on the fact the proposed method of construction in the floodplain will have no impact on the floodplain or any wetland. The only feasible alternative for replacing the raw sewage pumps within Lift Station 1 is within the existing wet well. The replacement of the sewage pumps and the controls for the new units will not need excavation or backfilling within the lift station area. The only feasible alternatives for the Lift Station 1 improvements (relocating lift station 1 or doing nothing) will either incur additional costs or result in increased health concerns due to raw sewage exposure. The conclusion is, the proposed replacement of pumps and controls within the existing Lift Station 1 area should be implemented. The proposed construction method does not impact the flood plain or wetlands and will require minimal if any restoration to preserve the natural and beneficial values of the floodplain. The City of Austin will construct the project implementing the proposed route with proper over site to ensure compliance.
