AUSTIN ECONOMIC DEVELOPMENT COMMISSION

NOTICE OF PUBLIC HEARINGS

The Austin Economic Development Commission (“Commission”) will hold public hearings (“Hearings”) at 12:00 p.m. on Thursday May 7, 2026, in the Common Council Chambers of the Austin City Hall, located at 80 W. Main Street, Austin, Indiana 47102, regarding: (i) a proposed financing to finance the construction and development of certain public infrastructure improvements, including, but not limited to, mass grading and drainage, sanitary sewer improvements, storm sewer improvements, water mains and hydrants, roadways, curbs, sidewalks, street lights, and other related infrastructure improvements (collectively, the “Infrastructure Improvements”), to support the construction of a residential development, consisting of approximately 54 single-family lots in phases (“Development” and, together with the Infrastructure Improvements, collectively, the “Project”) to be constructed by Develop Austin LLC (the “Company”), which such improvements are located in the City of Austin, Indiana (“City”) and are located in or physically connected to the Austin Residential Economic Development Area (the “Austin Residential EDA”); (ii) the issuance of the City’s Taxable Economic Development Revenue Bonds of 2026 (York Woods Crossing Project) (“Bonds”), in one or more series, in the aggregate principal amount not to exceed One Million Three Hundred Fifty Thousand Dollars ($1,350,000) to finance a portion of the costs of construction of the Infrastructure Improvements; (iii) a proposed forgivable economic development revenue loan(s) in one or more series (the “Forgivable Loan”) from the proceeds of the Regional Economic Acceleration and Development Initiative 2.0 in an amount not to exceed Two Million Dollars ($2,000,000) (“READI Funds”), and certain local contributions made available for the Infrastructure Improvements, including utility contributions, land sale proceeds, and other local contributions in an amount not to exceed Six Hundred Thousand One Hundred Ninety-Nine Dollars ($600,199) (collectively, “Local Contributions”), to finance additional costs of the Infrastructure Improvements; and (iv) to consider whether this financing will have an adverse competitive effect on any similar facilities already constructed or operating in the City.

The Bonds will be issued by the City pursuant to I.C. 36-7-11.9, 36-7-12, 36-7-14 and 36-7-25, and an ordinance to be adopted by the Common Council of the City (“Ordinance”). The Bonds will not be payable in any manner by general taxation but will be payable solely from TIF Revenues (as defined in the Ordinance), Taxpayer Agreement (as defined below) payments, and Bond proceeds; provided, however, that the City of Austin Redevelopment Commission (“Redevelopment Commission”) will enter into a taxpayer agreement and consent to real property tax lien executed by and among the Redevelopment Commission, the City, and the Company (“Taxpayer Agreement”), and as otherwise provided in the Financing and Covenant Agreement by and between the City and the Company (“Financing Agreement”), the Trust Indenture between the City and The Bank of New York Mellon Trust Company, N.A., as trustee, and the Ordinance related to the Bonds. The Forgivable Loan will be made by the City pursuant to I.C. 36-7-11.9 and I.C. 36-7-12, the Forgivable Loan Agreement between the City and the Company, and an ordinance to be adopted by the Common Council of the City and will be funded from the proceeds of the READI Funds and Local Contributions. 

Proceeds of the Bonds and the Forgivable Loan will be used for the construction and development of the Infrastructure Improvements to be located in or physically connected to the Austin Residential EDA in the City.

The public hearings are being held pursuant to I.C. 36-7-12-24. The public is invited to attend and comment on any of the matters herein noted. Written comments may also be submitted to the Commission until Monday May 4, 2026 at 12:00 p.m., by delivering such comments to the office of the Clerk-Treasurer at Austin City Hall, 80 W. Main Street, Austin, Indiana 47102.
