Pursuant to I.C. 36-7-4-920, the City of Salem, Washington County, Indiana (the “City”) gives notice of a public hearing to be conducted by the Board of Zoning Appeals (the “BZA”) regarding and Application for Development Standards Variance under the Salem Zoning Ordinance (the “Application”) submitted by TeleCAD Wireless Site Design, Inc on behalf of APC Towers (the “Applicant”) relating to the property located at 304 W Homer St, Salem, IN 47167, bearing parcel ID 88-24-17-223-006.000-022 (the “Property”). The Applicant seeks a developmental standards variance for the Property for proposed construction of a 160’ (170’ overall height with lightning rod) monopole communications tower. NOTICE OF EXECUTION OF AND  DETERMINATION TO ENTER INTO FOURTH AMENDMENT TO LEASE

Notice is hereby given that the Board of School Trustees of Crothersville Community Schools (“Board” and “School Corporation”, respectively) on March 10, 2025, determined to enter into and executed on behalf of the School Corporation, a Fourth Amendment to Lease (the “Fourth Amendment to Lease”) between the School Corporation and the Crothersville 2000 School Building Corporation (the “Building Corporation”), which amends a Lease dated as of December 15, 2000 (the “Original Lease”), as amended by an Amendment to Lease dated as of March 30, 2005 (the “First Amendment to Lease”), a Second Amendment to Lease dated as of March 11, 2015 (the “Second Amendment to Lease”), a Third Amendment to Lease dated as of October 11, 2021 (the “Third Amendment to Lease,” and together with the Original Lease, the First Amendment to Lease, the Second Amendment to Lease and the Third Amendment to Lease, the “Lease”), between the School Corporation and the Building Corporation.  The Fourth Amendment to Lease permits the financing of: (a) comprehensive HVAC upgrades, renovations, replacements and repairs at all school corporation facilities, (b) related heating, cooling, air handler system and chiller repairs, equipping and upgrades, (c) boiler repairs, replacements and upgrades, (d) related plumbing and electrical renovations, (e) cafetorium sound system upgrades and improvements, (f) fire alarm upgrades, (g) parking lot repairs, and (h) other related repairs, upgrades and renovations.  Approval and execution of the Fourth Amendment to Lease was made following the publication of notice and public hearings made and held in accordance with Indiana Code 20-47-3-9.  The Lease rentals due under the Fourth Amendment to Lease are in excess of $5,000.  This notice is provided in accordance with the provisions of Indiana Code 20-47-3-11 and 6-1.1-20-5.
