NOTICE OF ADOPTION AND PURPORT OF AN ORDINANCE AUTHORIZING THE ACQUISITION, CONSTRUCTION, AND INSTALLATION BY THE CITY OF AUSTIN, INDIANA, OF CERTAIN IMPROVEMENTS TO THE CITY’S SEWAGE WORKS UTILITY, THE ISSUANCE AND SALE OF SEWAGE WORKS REVENUE BONDS AND BOND ANTICIPATION NOTES TO PROVIDE FUNDS FOR THE PAYMENT OF THE COSTS THEREOF, AND THE COLLECTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF SUCH SEWAGE WORKS AND OTHER RELATED MATTERS
Property owners, ratepayers, and other interested parties in or served or to be served by the sewage works of the City of Austin, Indiana (the “City”) are hereby notified that on March 11, 2025, the Common Council of the City adopted Ordinance No. 2025-02 (the “Ordinance”), determining to construct improvements to the City’s sewage works as outlined in the Ordinance, including to construct, install, and/or acquire certain photovoltaic solar energy arrays to serve the City’s wastewater treatment plant (the “Project”).
The total estimated cost of the Project, including all costs of issuance, is not expected to exceed the sum of $6,000,000. The Ordinance further directs that the costs of the Project shall be financed by the issuance of taxable or tax-exempt bond anticipation notes in an amount not to exceed $1,200,000 (the “BANs”), and, if necessary, sewage works revenue bonds, in one or more taxable or tax-exempt series, designated as the “Sewage Works Revenue Bonds of 20___” (to be completed with the year in which issued and with such further or different series designations as may be necessary or appropriate), in an amount not to exceed $1,200,000 (the “Bonds”). If issued, such Bonds will be payable solely from the Net Revenues (as defined in the Ordinance) of the Sewage Works (as defined in the Ordinance), with interest payable on a parity with the 2016 Bonds (as defined in the Ordinance). The interest on the BANs shall be payable semi-annually on a parity with the 2016 Bonds either from the Net Revenues of the Sewage Works or from proceeds from the issuance and sale hereunder of the Bonds.
The BANs will be issued pursuant to I.C. 5-1.2-1 through I.C. 5-1.2-4, I.C. 5-1.2-10, I.C. 5-1.2-11, I.C. 5-1.2-14 and/or I.C. 5-1.2-14.5 if sold to the Authority, I.C. 5-1.5-8-6.1 if sold to the Indiana Bond Bank, or pursuant to I.C. 5-1-14-5 if sold to a financial institution or any other purchaser, each as amended, and may be sold to a financial institution or any other purchaser, at an interest rate not to exceed six percent (6%) per annum, and will mature no later than three (3) years after their date of delivery. The Bonds, if necessary, are expected to be sold to the Indiana Bond Bank, the Indiana Finance Authority, or otherwise at a public sale or other negotiated sale pursuant to I.C. 5-1-11, at an interest rate not to exceed six percent (6%) per annum, and will mature semi-annually on January 1 and July 1, over a period ending no later than January 1, 2047. Copies of the Project cost estimates along with a copy of the Ordinance are on file in the office of the Clerk-Treasurer and are available for inspection by any interested parties during regular business hours. Objections to said Project and the Bonds and BANs may be filed in the time and manner provided by I.C. 36-9-23.

Finding of No Significant Impact
It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above named City of Scottsburg has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (P.L. 91-190). The reasons for such decision not to prepare such statement are as follows:
All preliminary environmental reviews by state and county agencies indicated that the proposed project would not endanger the environment under any capacity.
An Environmental Review Record regarding the proposed project has been made by the above-named City of Scottsburg which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required. This Environmental Review Record is on file at the above address and is available for public examination and copying upon request the Scottsburg City Hall between the hours of 8:30 A.M. and 4:30 P.M., Monday through Friday. Should city offices be closed, the ERR will be made available to the public for review either electronically or by U.S. mail. Public Comments of Findings

Release of Funds
The City of Scottsburg will undertake the project described above with Community Development Block Grant funds from the State of Indiana under Title I of the Housing and Community Development Act of 1974. The City of Scottsburg is certifying to the State that the City of Scottsburg and Terry Amick, in his official capacity as Mayor consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval the City of Scottsburg may use the Block Grant funds and the State will have satisfied its responsibilities under the National Environmental Policy Act of 1969.
Objections to State Release of Funds
The State will accept an objection to its approval only if it is on one of the following basis: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by the State; or (b) that the applicant’s environmental review record for the project indicated omission of a required review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be submitted to Grant Services & OCRA through the ER Report in GMS.
Objections to the release of funds on basis other that those stated above will not be considered by the State. No objections received after April 14, 2025 will be considered by the State.

Because no action nor response has ever been taken regarding the previous Orders, the required clean up, or abatement of the described property, the Board determined to let public bids for abatement and removal. After public bid to ensure the lowest possible cost associated with the performance of the work, the County determined to accept the lowest and responsible offeror to perform the work.

3. The work shall be performed at an amount not to exceed $7,500.00, and this amount which represents a reasonable payment for the work performed may be recorded as a lien against all persons having an interest in the property, after a hearing.
4. The bids were opened in public meeting before the Scott County Board of Commissioners.
5. The licensed contractor shall perform this work as soon as practicable to abate the potential harm created by the unsafe premises.
