Cause No. 72D01-2402-AD-011
SUMMONS AND NOTICE OF ADOPTION
Michael Foust, who has been named the father of the child born to Kendra Rae Campbell on April 25, 2009, and Kendra Rae Campbell are notified that a petition for adoption of their child February 29, 2024, was filed in the office of the Clerk of Court, One East McClain Avenue, Scottsburg, Indiana 47170. The petition for adoption alleges that the consent to adoption by Michael Foust and Kendra Rae Campbell is not required because they has abandoned or deserted the child for at least six (6) months immediately preceding the date of the filing of the petition for adoption and/or for the reason that the child has been in the custody of the petitioners for at least one (1) year when Michael Foust and Kendra Rae Campbell have failed without justifiable cause to communicate significantly with the child when able to do so, and/or knowingly failed to provide for the care and support of the child when able to do so as required by law or judicial decree.
If Michael Foust and/or Kendra Rae Campbell seek to contest the adoption of the child, Michael Foust and/or Kendra Rae Campbell, he or she must file a motion to contest the adoption in accordance with IC 31-19-10-1 in the above named court not later than fifteen (15) days after the date of service of this notice.
If Michael Foust and Kendra Rae Campbell do not file a motion to contest the adoption within fifteen (15) days after service of this notice (the date of the last of 3 publications) the above named court will hear and determine the petition for adoption. The consent to adoption of Michael Foust and Kendra Rae Campbell will be irrevocably implied and Michael Foust and Kendra Rae Campbell will lose the right to contest either the adoption or the validity of Michael Foust and Kendra Rae Campbell implied consents to the adoption. Michael Foust and Kendra Rae Campbell will lose their rights to establish each of their rights to paternity of the child, by affidavit or otherwise, in Indiana or any other jurisdiction.
No oral statement made to Michael Foust and/or Kendra Rae Campbell relieves either him or her of their obligations under this notice. Under Indiana law, a putative father is a person who is named as or claims that he may be the father of a child born out of wedlock but who has not yet been legally proven to be the child’s father. For purposes of this notice, Michael Foust is a putative father under the laws in Indiana regarding adoption.
This notice complies with IC 31-19-4.5-3 but does not exhaustively set forth a person’s legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana adoption statutes or an attorney of his or her choice.
