Notice is hereby given, that the Stucker Fork Conservancy District, hereinafter referred to as the Owner, will receive sealed bid packets for the Repainting of the 100,000 Gallon Elevated Tank No. 2 (Little York) and the 100,000 Gallon Elevated Tank No. 4 (Commiskey).

Sealed bids are invited and must be received by the Owner at Stucker Fork Conservancy District, 2260 U.S. Highway 31, Austin, IN 47102, no later than 2:00 P.M. Eastern (local time) on April 11, 2024. If bids are forwarded by mail, the sealed envelope must be enclosed in another envelope addressed to the Owner at P.O. Box 274, Scottsburg, IN 47170. Bids received after such hour will be returned unopened. Bids received prior to this time shall be opened and publicly read at the public meeting scheduled to take place on April 11, 2024 at 2:00 P.M. Eastern (Local Time) at the office of Stucker Fork Conservancy District, 2260 U.S. Highway 31, Austin, IN 47102.

When plans and specifications are ordered from midwesterneng.com/planroom, instructions for payment will be provided in the downloading process. Requests for plans and specifications sent to the office of Midwestern Engineers, Inc., for a paper bound set, shall be accompanied by a check or money order. All service charges for viewing are non-refundable.

The work to be performed and the bid to be submitted shall include sufficient and proper sums for all general construction, mechanical installation, labor, materials, permits, licenses, insurance, and so forth incidental to and required for the construction of the facilities.

Each bid must be enclosed in a sealed envelope bearing the title of the Project and the name and address of Bidder. All bids must be submitted on the bid forms as identified in the Contract Documents and Specifications.

Each bid shall be accompanied by a certified check or acceptable bidder’s bond made payable to the Owner, in a sum of not less than five percent (5%) of the total amount of the highest aggregate bid, which check or bond will be held by the Owner as evidence that the bidder will, if awarded the contract, enter into the same with the Owner upon notification from him to

do so within ten (10) days of said notification. Bidders bond must include a certified copy of the power of attorney.

Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. The bonds will be in the amount of 100% of the Contract Price and must be in full force and effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion.

Bid security of the three lowest Bidders will be retained until the Contract has been awarded and executed, but no longer than ninety (90) days from the date of opening Bids. The Owner reserves the right to reject any bid, or all bids, or to accept any bid or bids, or to make such combination of bids as may seem desirable, and to waive any and all informalities in bidding. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bid may be withdrawn after the scheduled closing time for receipt of bids for at least ninety (90) days.

A conditional or qualified Bid will not be accepted. Award will be made to the low, responsive, responsible bidder.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Bids shall be properly and completely executed on bid forms included in the Specifications. Bids shall include all information requested by Indiana Form 96 (Revised 2013) included with the Specifications. Under Section III of Form 96, the Bidder shall submit a financial statement. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.

Each Bidder is responsible for inspecting the Project site(s) and for reading and being thoroughly familiar with the Contract Documents and Specifications. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid.

ORDINANCE 2024-OR-2

WHEREAS, pursuant to Indiana Code § 5-14-3.3 a county may enact an ordinance pursuant to Indiana Code § 4-22-2; and

WHEREAS, Indiana Code § 4-22-2 permits the County to enact an ordinance to prohibit information obtained from the County for a commercial purpose; and

WHEREAS, the fine for a violation of said Ordinance is One Thousand and 00/100 Dollars ($1,000.00); and

WHEREAS, the County also has the authority to charge Fifty and 00/100 Dollars ($50.00) to mortgage companies, title companies, or companies requesting tax data or tax files to assist with their escrow payments or delinquent payments of taxes to Scott County; and

WHEREAS, there is a need for the Scott County Council to create an fund via Ordinance where the fines and costs are to be deposited.

NOW THEREFORE, BE IT AMENDED AND ORDAINED AS FOLLOWS BY THE BOARD OF COMMISSIONERS OF SCOTT COUNTY, INDIANA:

1. A violation of this Ordinance will cause the person, entity, corporation, company, or proprietorship to be prohibited from obtaining any further information and may result in a maximum fine of One Thousand and 00/100 Dollars ($1,000.00).

2. Pursuant to I.C. 4-22-1-19.6(c), the County will charge Fifty and 00/100 ($50.00) to mortgage companies, title companies, or companies requesting tax data or tax files to assist with their escrow payments or delinquent payments of taxes to Scott County. The amount of the fee is reasonably based upon the amount necessary to carry out the purpose for which the fee is imposed.

3. Any and all fees and fines collected as result of this Ordinance shall be placed in a separate Treasurer Technology Fund for purchase of specific items not contained in the Treasurer’s regular budget. The fund and Ordinance establishing the fund shall be approved at the discretion of the Scott County Council.

4. This Ordinance is effective upon the passage, signing, and recording by the presiding officer of the respective executive of the County and upon the passage and recording of the Ordinance establishing the fund for the deposit of fines and fees.
