ORDINANCE NO. 2023-OR-

ORDINANCE ALTERING SPEED LIMITS ON CERTAIN ROADWAY

WHEREAS, pursuant to I.C. 5-22-2-13, the Scott County is a governmental body, and under I.C. 36-2-2-2, the Board of Commissioners is the County Executive for Scott County;

WHEREAS, in pertinent part, I.C. 9-21-5-3 states, “[t]he maximum speed limits set forth in section 2 of this chapter may be altered as follows: (a) by local jurisdictions under section 6

of this chapter”;

WHEREAS, I.C. 9-21-5-3 provides that “whenever a local authority in the authority’s jurisdiction determines that the maximum speed permitted under this chapter is greater or less than reasonable and safe under the conditions found to exist on a highway or part of a highway, the local authority may determine and declare a reasonable and safe maximum limit on the highway”;

WHEREAS, prior to altering a speed limit, the local jurisdiction “must perform an engineering and traffic investigation”;

WHEREAS, the Board of Commissioners, having performed an engineering and traffic investigation as part of the Scott County Bridge No. 28 (72-00028), for the Leota Road over Big Ox Creek, determines that the maximum speed permitted under state law is greater than reasonable and unsafe under the conditions found to exist on a highway;

WHEREAS, the Board of Commissioners of Scott County incorporates the engineering and traffic investigation findings as the basis for its determination, and attaches them to this Ordinance as “Exhibit A”.

NOW, THEREFORE, BE IT ORDAINED BY BOARD OF COMMISSIONERS OF SCOTT COUNTY, INDIANA:

1. The Board of Commissioners of Scott County has determined that maximum speed limit on the roadway– that being the roadway of Leota over Big Ox Creek and all approaches to the bridge– is greater than reasonable and unsafe under the conditions found to exist on a highway.

2. Pursuant to I.C. 9-21-5-3 and I.C. 9-21-5-6, the Board of Commissioners determine to alter the maximum speed limit to 45 mph for the above-described roadway to ensure the continued safety of traveling public.

3. This Ordinance is effective upon the passage, signing, and recording by the presiding officer of the respective executive of the County and upon posting of the speed limits signage along the described roadway.

Notice is hereby given that sealed bids will be received by the Scott County School Board District 1 for new tennis courts at 273 E. Main Street, Austin, IN 47102. The project is called “SCOTT COUNTY SCHOOLS – TENNIS COURTS”. Sealed proposals may be

delivered or forward by certified mail, until 2:00 p.m. local time on the 8th day of January, 2024, to the Scott County School Board District #1, 255 Highway 31 South, Austin IN 47102. Bids received after such hour will be returned unopened.

This Project involves the installation of the following:

•2” Binder and 1.5” of #11 Surface mix asphalt.

•Installation of 5 Tennis Courts per U.S.T.A standards and tolerances

•Installation 10’ black vinyl fence around the 5 tennis courts.

•Installation of saw cuts and fill between courts and under net line.

•Install 5 sets of Douglas Premier Round net posts and center pipe anchors.

•Apply 2 coats of Acrylic Resurfacer to the new asphalt

•Apply 3 coats of Fortified Laykold Color Concentrate to 5 courts, color (standard color only) shall be determined by owner.

•Layout and stripe courts with 2” wide lines as per U.S.T.A. standards and tolerances.

•Provide and install 5 Douglas TN-36T tennis nets and center straps.

•Proper outdoor tennis court lighting.

Bids shall be opened and publicly read aloud at 2:00 p.m. on the 8th day of January, 2024, at the Scott County School Board District #1, 255 Highway 31 South, Austin IN 47102.

The bidder must file with their sealed bid proposal, a certified check or a bid bond in the amount equal to ten (10) percent of the total bid, payable to the Scott County School Board District 1. The above check or bond is to insure the execution of the contract on which such bid is made.

The qualified Contractor to whom the work is awarded shall furnish, within ten (10) days after the date of said contract award and before commencing work, a performance and payment bond in an amount equal to the bid price of the contract awarded to said contractor, and certificates of all insurance required by the Specifications.

The Bid security of the three lowest Bidders will be retained until the Contract has been awarded and executed, but no longer than sixty (60) days from the date of opening Bids. The Owner reserves the right to reject any proposal, or all proposals, or to accept any proposal or proposals, or to make such combination of proposals as may seem desirable, and to waive any and all informalities in bidding. Any proposal may be withdrawn prior to the above scheduled time for the opening of proposals or authorized postponement thereof. Any proposal received after the time and date specified shall not be considered. No proposal may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days.

Award will be made to the lowest, responsive, responsible bidder.
