Napier, born to Tracey Napier, on September 4, 2012, was filed in the office of the clerk of the Scott Superior Court, Courthouse, 1 East McClain Avenue, Suite 120, Scottsburg, Indiana 47170. The Petition for Adoption alleges that the consent to adoption of Tracey Napier is not required because: (1) for a period of at least one year she has failed without justifiable cause to communicate significantly with the child when able to do so or has knowingly failed to provide for the care and support of the child when able to do so as required by law or judicial decree, and/or (2) because she is unfit to be a parent and the best interests of the child would be served if the court dispensed with her consent.
