The Board of Zoning Appeals of the City of Seymour, Indiana will hold a public hearing on the 22nd day of August 2023 at 7:00 p.m. at Seymour City Hall, 301-309 N Chestnut St, Seymour, Indiana, enter 3rd St. entrance, (via GoToMeeting https://global.gotomeeting.com/join/384057085) on an “Application for Development Standards Variance” for real estate within the jurisdiction of the Board of Zoning Appeals. The applicant is requesting a Variance at 6802 Coreopsis Ln. They are wanting to vary from setbacks to put up a fence. They live on a corner lot which restricts where they can place it. (The fence is already up, contractor thought it was included in plans.).

Code § 36-7-4-607, the City of Scottsburg Advisory Plan Commission (the “Plan Commission”) has initiated proposed amendments to the text of the Scottsburg Zoning Ordinance (Ordinance No. 2004-13) by (i) amending Article 3(G)(2) to add Extended Stay Hotel/Motel as a permitted use in the B-3 (Highway Business) district, (ii) adding a definition of Extended Stay Hotel/Motel and amending definitions of Hotel and Motel uses in Article 11(M), and (iii) amending Article (5)(W) to establish regulations and development standards for Extended Stay Hotel/Motel uses. The hearing will be held during the Plan Commission regular meeting that begins at 6:00 P.M., at Scottsburg City Hall, 2 East McClain Street, Scottsburg, Indiana, on August 21, 2023.

The complete proposal for the text amendments to the Scottsburg Zoning Ordinance is on file and available for public inspection during regular business hours in the Plan Commission Office at Scottsburg City Hall, 2 E. Written comments received by the Plan Commission staff prior to the public hearing shall be placed into the record of the public hearing. LEGAL NOTICE

Final Notice and Public Explanation of a Proposed Activity in a 100-Year Floodplain

This is to give notice that the City of Austin has conducted an evaluation as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential affect that its activity in the floodplain and wetland will have on the human environment for a Stormwater Improvement Project under a HUD Community Development Block Grant through the Office of Community and Rural Affairs (OCRA). The proposed project(s) is located in the following areas:

•The first area is located in the northeastern part of the city along both the east and west sections of North Street. This includes a portion of First Street and Gary Ave.

•The second area is located in the central portion of the city along English Avenue (between 4th Street and 7th Street) and Cherry Street (between 4th Street and 7th Street)

•The third area is located in the far western portion of the city that includes the Kenwood Drive & Tibbs Street area.

These areas are located in the City of Austin, Scott County. The proposed project is constructing “V” ditches in these areas. Existing earthen ditches should be re-graded with adequately sloped paved ditch or piping to provide positive drainage, thus eliminating standing water conditions. There is a small portion of this project that is located within a Zone A Floodplain. The total project area near/in the floodplain is 1.6 acres. The total number of acres located in the floodplain is .7 acres.

The City of Austin has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and

beneficial values:

While regrading and constructing paved “V” ditches was determined to be the best option, there were 3 other alternatives considered:

1-Piping existing roadside ditches were evaluated in-lieu of improving the existing ditches in the project areas. This alternative would accomplish the same thing as the proposed project by eliminating the standing water along the roadside ditches and removing failing and undersized culverts. This alternative was not selected because the estimated price was between two to three times as the proposed project scope. There would also be additional grading on individual lots that would be challenging obtaining all construction easements.

2-Complete road reconstruction which would allow contractors to create needed slopes for water to drain adequately. This option would not only be extremely expensive but would

possibly need to eliminate some of the homes on the street to allow for the correct pitch of roadway while not directing water to homes.

3-No action alternative where nothing is done. There would continue to be standing water and the existing drainage infrastructure would continue to silt up. Over time there could be additional unforeseen flooding caused by the failing infrastructure. The standing water will also increase the mosquito populations causing a public health risk.

This project will comply with state and local floodplain protection procedures.

The City of Austin has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and/or 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. This activity will have no significant impact on the environment for the following reasons:

The proposed construction method does not impact the floodplain or wetlands and will require minimal if any restoration to preserve the natural and beneficial values of the floodplain.

There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information about floodplains can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

By publication of this notice, the City of Austin is inviting any final comments prior to undertaking the proposed action. If the minor child attends the hearing, opposes the Petition, and is not represented by an attorney, the Court may appoint an attorney to represent the minor child. The Court may, where required, appoint a guardian ad litem to represent L.S.M.J. at the hearing.

The Court may, on its own motion or on request of any interested person, postpone the hearing to another date and time.
