Notice is hereby given to the taxpayers of Scott County, Indiana, that the proper legal officers of Scott County at their regular meeting place at Scott County Courthouse Annex, at 5:30 p.m. on the 30th day of May, 2023, will consider the following appropriations in excess of the budget for the current year.

LEGAL NOTICE

NOTICE OF ADOPTION AN ORDINANCE REGARDING BILLING PROCEDURES FOR MUNICIPAL UTILITIES FOR THE TOWN OF

CROTHERSVILLE, INDIANA

Taxpayers, property owners, and other interested parties in the Town of Crothersville, Indiana (“Town”), are hereby notified that the Town Council adopted an ordinance concerning billing procedures for municipal utilities and rental properties under IC § 8-1.5-3-8. The effective date of the ordinance is May 2, 2023.

ORDINANCE NO. 2023 – 1

AN ORDINANCE AMENDING THE CROTHERSVILLE TOWN CODE CONCERNING BILLING PROCEDURES FOR MUNICIPAL UTILITIES AND RENTAL PROPERTIES

UNDER IC § 8-1.5-3-8

WHEREAS, the Town of Crothersville, Indiana (“Town”) operates water and sewer utilities for the benefit of the citizens and the surrounding area;

WHEREAS, various ordinances have been adopted from time to time regarding policies and procedures for the water and sewer billing procedures;

WHEREAS, it has been determined by the Attorney General of the State of Indiana as follows:

If a tenant is responsible for payment of utilities under a lease, a municipal utility cannot hold the landlord responsible for payment unless the landlord is a party to the service agreement; and

The municipal utility cannot deny service to subsequent occupants of the property, and unpaid utility bills do not constitute a lien on the property; and

Although the statute does not explicitly prohibit a municipal utility from requiring a property owner to sign for the account with a tenant, so that the landlord is responsible for the tenant’s delinquent bills, such a requirement is contrary to the purpose of the statute as a whole and may not be permissible under the Indiana Home Rule Act.

NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CROTHERSVILLE, INDIANA:

1. Any provision of the Crothersville Code of Ordinances:

a. Requiring a landlord who is not a party to the town’s utility service agreement to be responsible for payment of a tenant’s utilities; or

b. Permitting the denial of service to subsequent occupants of the property due to an unpaid utility bill;

c. Allowing the filing of liens on a property where the landlord is not a party to the service agreement;

d. Mandating that the landlord to sign for the account and assume is the responsibility for a tenant’s delinquent utility bills

are hereby repealed and of no further force and effect.

2. Applicants or customers registering a new account shall pay a fifty dollar ($50) deposit prior to beginning of service.

3. All other provisions of the Town Code not modified by this ordinance shall remain in full force and effect.

4. The provisions herein, when approved and adopted, shall be effective beginning with the June 2023 billing period.

5. This Ordinance shall be in effect from and after its passage by the Town Council in accordance with law.

ADOPTED BY THE TOWN COUNCIL this 2nd day of May, 2023.
