Cause No.:  72D01-2208-AD-0039

IN THE MATTER OF THE ADOPTION OF ALLYSON MARIE PRICE, A MINOR.

NOTICE OF ADOPTION TO JENNIFER ALISSA WHITTAKER

TO:  Jennifer Alissa Whittaker

Whose Whereabouts are Unknown

Jennifer Alissa Whittaker is notified that a petition for adoption of a child, named Allyson Marie Price, born to Jennifer Alissa Whittaker on January 8, 2020, was filed in the office of the clerk of the Scott Superior Court, Courthouse, 1 East McClain Avenue, Suite 120, Scottsburg, Indiana 47170. The petition for adoption alleges that the consent to adoption of Jennifer Alissa Whittaker is not required because: (1) for a period of at least one year she has failed without justifiable cause to communicate significantly with the child when able to do so or has knowingly failed to provide for the care and support of the child when able to do so as required by law or judicial decree,  (2) because she is unfit to be a parent and the best interests of the child would be served if the court dispensed with her consent and/or (3) she has abandoned the child.

If Jennifer Alissa Whittaker seeks to contest the adoption of the child, Jennifer Alissa Whittaker must file a motion to contest the adoption in accordance with IC 31-19-10-1 in the above-named court not later than thirty (30) days after the date of service of this notice.

If Jennifer Alissa Whittaker does not file a motion to contest the adoption within thirty (30) days after service of this notice the above-named court will hear and determine the petition for adoption. The consent to adoption of Jennifer Alissa Whittaker will be irrevocably implied and Jennifer Alissa Whittaker will lose the right to contest either the adoption or the validity of Jennifer Alissa Whittaker’s implied consent to the adoption.

No statement made to Jennifer Alissa Whittaker relieves Jennifer Alissa Whittaker of Jennifer Alissa Whittaker’s obligations under this notice.

This notice complies with IC 31-19-4.5-3 but does not exhaustively set forth a person’s legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana adoption statutes.
