LEGAL NOTICE

NOTICE OF ADOPTION OF AN ORDINANCE PERMITTING  CHICKENS WITHIN THE TOWN OF CROTHERSVILLE, INDIANA

Taxpayers, property owners, and other interested parties in the Town of Crothersville, Indiana (“Town”) are hereby notified that the Town Council adopted an ordinance permitting chickens within the Town of Crothersville.  The effective date of the ordinance is September 7, 2022.

ORDINANCE NO. 2022 – 10

AN ORDINANCE OF THE TOWN OF CROTHERSVILLE PERMITTING CHICKENS

WHEREAS,§ 90.20 of the Crothersville, Indiana Code of Ordinances, makes it unlawful to “keep, harbor, possess, house, or maintain . . . poultry or fowl” within the corporate limits of the Town of Crothersville, Indiana; and

WHEREAS, the Town Council of Crothersville, Indiana, believes it would be in the best interest of the citizens of the Town to allow the permitted maintaining of a limited number of chickens (hens) for residential use within the Town; and

WHEREAS, The Town of Crothersville, Indiana, hereby amends the prohibition of “poultry or fowl”, as codified in § 90.20 of the Crothersville, Indiana Code of Ordinances, and subject to this ordinance. 

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CROTHERSVILLE, AS FOLLOWS:

Section 1: § 90.20 of the Crothersville Code of Ordinances, is hereby amended to specifically omit chickens, as defined below, from the definition of “poultry or fowl”, and the keeping, harboring, possessing, housing, or maintaining thereof, which shall governed by this ordinance.

Section 2: Definition:  Urban Chicken:  means a chicken living within the corporate limits of the Town of Crothersville, Indiana, officially known as Gallus Domesticus, which is a domestic bird.  It does not include other fowl such as, but not limited to, roosters, peacocks, turkeys, or waterfowl.  Urban chickens are governed by this ordinance, as may be amended from time to time.

Section 3: Chickens, as defined herein, may be kept within the Town corporate limits, subject to strict compliance with the following guidelines and rules:

a) No roosters (male chickens) may be kept under the provisions of this section.

b) There shall be no more than four (4) chickens permitted per residence.

c) Chickens are not permitted to free-range and must be kept completely and securely enclosed under the control of the owner and on the owner’s property at all times. 

d) Enclosure for chickens within Town corporate limits shall be as follows: 

i. A chicken coop and chicken pen must be constructed in such a manner as to keep the chickens enclosed.  The chickens must remain in the pen.  The chicken coop shall be enclosed with solid material on all sides and have a solid roof and door(s).  The coop shall be at least eighteen (18) inches high and provide at least two (2) square feet of floor area per chicken, and shall be impermeable to rodents, wild birds, and predators, including dogs and cats. 

ii. Traditional building materials shall be used.  Doors shall be constructed so that they close and lock.  Vents shall be covered with wire and should be placed as necessary for adequate ventilation. 

iii. The pen shall be impermeable to rodents, wild birds, and predators, including dogs and cats.  The pen shall provide at least five (5) square feet of area per chicken. 

iv. The fence shall rise no more than six (6) feet above ground. 

v. The pen shall be covered with wire, aviary netting, or solid roofing.

e) Chickens shall be provided access to feed and clean water at all times.

f) All feed for said chickens shall be stored in containers so as to protect against intrusion of rodents or vermin.

g) The chicken coops shall be maintained in a sanitary condition and in compliance with all applicable health regulations of the State, County, and Town.

h) Chickens and chicken coops shall be confined to the rear yard of the owner’s property.

i) Any chickens kept in accordance with the premises of this section shall be for non-commercial, personal use only and may not be slaughtered on the property.

j) Any person desiring to raise urban chickens within Town corporate limits must file an application for an urban Chicken Permit with the Town Hall prior to obtaining the chickens.  The application must include a diagram of location, size, and building material, as well as a design or picture of the enclosure.  The fee for the permit is $20.00 annually.

k) In the event a permit is denied by the Town Council, the applicant may request a separate appeal hearing before the Town Council.

l) Violation of ordinance standards, rules, or regulations shall result in permit revocation and civil penalties.

i. Civil penalties may range from $100 per day to $2,500 per day, until the violation is remedied.

m) If the permit application is approved, the owner will receive notification of approval, which must be renewed annually.

n) No chickens shall be permitted in multi-family dwellings. 

Section 4: If any section, paragraph, clause, or phrase of this ordinance be declared unconstitutional or invalid, the remainder of said ordinance shall continue in full force and effect.

Section 5: All prior ordinances or parts thereof inconsistent with any provision of this ordinance are hereby repealed.

Section 6: This Ordinance shall be in full force and effect from and after its passage, and approval by the Town Council, all as by law provided.

ADOPTED BY THE TOWN COUNCIL this 6th day of September, 2022.
