SCOTT COUNTY ORDINANCE #2022-007

An Ordinance Regulating Commercial Thru Traffic on US Highway 31 Detours During the INDOT Pigeon Roost Bridge Replacement Project

WHEREAS US Highway 31 in Scott County, Indiana between Radio Tower Road and State Road 356 will be closed due to construction beginning July 2022 until completion; and

WHEREAS, due to presumably inaccurate global position satellite guidance systems/maps, the drivers of many commercial vehicles and commercial combination vehicles, including maximum length semi-tractor, will not be directed, or routed to travel on the proper designated STATE OFFICIAL ROAD DETOUR(S); and

WHEREAS Indiana Codes 36-7-2-7 and 8-17-1-40 permit a governmental unit to regulate the use of public ways and county legislative bodies to adopt ordinances regulating traffic on any highway in the county highway system subject to Indiana Code 9-21; and

WHEREAS the operation of and thru traffic, consisting of commercial vehicles, commercial combination vehicles, maximum length semi-tractor by drivers of said vehicles, who are unfamiliar with intersections and structures that limit the safe travel of such commercial vehicles and tractors, endangers the safety or property of others and blocks the proper flow of traffic; and

WHEREAS, Indiana Clod 9-21-8-49 provides that a person violating traffic regulation laws commits a Class C Infraction and Indiana Code 9-21-8-50 provides that “A person who operates a tractor-trailer combination in a reckless or deliberate attempt to: (1) Endanger the safety or property of others; or (2) Block the proper flow of traffic; commits a Class B Misdemeanor”; and pursuant to Indiana Code 9-21-1-2(c) a fine assessed for a violation of a traffic ordinance adopted by a local authority may be deposited into the General fund of Scott County.

WHEREAS, thru traffic consisting of commercial vehicles, commercial combination vehicles and/or semi-tractors with no intended point of pick up from or delivery to person or entities along the roads of Radio Tower, Underwood, and County Line, and subject to applicable statutory penalties in order to enhance the safety of others and property, and to prevent blocked flow of traffic, pursuant to the aforementioned statutes or as amended thereafter. 

NOW THEREFORE BE IT ORDAINED that:

1. All thru semi-tractor vehicles and equipment shall be prohibited on the roads of Radio Tower, Underwood, and County Line.

2. That the County Highway Garage personnel shall erect signs stating “NO THRU SEMI-TRACTOR VEHICLES” with plaques stating “$1000 FINE” at the roads of Radio Tower, Underwood, and County Line.

3. All repairs of any damaged roadway will need to be recovered by the County Highway Department.

4. Scott County, Indiana, by and through its Board of Commissioners, shall cooperate and remain subject to Indiana Code 9-21-1-4 and respectfully request the assistance of the Indiana Department of Transportation providing appropriate signs along US Highway 31 to provide appropriate notice to the drivers of thru-traffic commercial combination vehicles and/or semi-tractors.

5. That the penalty for a violation of said ordinance ranges from a Class C Infraction to a Class B Misdemeanor and $1,000 fine and court costs, pursuant to Indiana Code 9-21-1-49 and Indiana Code 9-21-1-50, respectively, or as amended thereafter.

BE IT FURTHER ORDAINED, that this Ordinance shall be effective Thirty (30) days following publication.
