COMMON COUNCIL OF THE CITY OF SCOTTSBURG, INDIANA

ORDINANCE NO. 2022-11

AN ORDINANCE AMENDING THE SCHEDULE OF RATES AND CHARGES COLLECTED BY THE SCOTTSBURG DEPARTMENT OF WATERWORKS AND ESTABLISHING NEW RATES AND CHARGES FOR THE SCOTTSBURG DEPARTMENT OF WATERWORKS AND OTHER MATTERS CONNECTED THEREWITH

WHEREAS, the Indiana Legislature has authorized the repeal of the Utility Receipts Tax (IC 6-2.3) in HEA 1002 effective July 1, 2022,

WHEREAS, the Scottsburg City Council has heretofore found that the existing rates and charges for the use of and services rendered by the municipal waterworks utility of Scottsburg include Indiana Utility Receipts Tax (URT) of 1.4%, and that as a result thereof, it is necessary that said rates be altered in order to remove the URT,

WHEREAS, the Board of Directors of the Department of Waterworks of the City of Scottsburg, Indiana, has adopted its Resolution No. 2022-R–1 recommending certain rates and charges be established for water service to customers served by the Scottsburg Water Utility, subject to the approval thereof by the Common Council of the City of Scottsburg, Indiana, and

WHEREAS, the Common Council now desires to adopt said Resolution and now therefore;

NOW, THEREFORE, BE IT HEREBY ORDAINED by the City Council of the City of Scottsburg, Indiana as follows:

SECTION 1: That the waterworks rates and charges set forth in Exhibit “A” attached hereto and made a part hereof are hereby adopted and established for the use of the service rendered by the Scottsburg Department of Waterworks beginning July 1, 2022.

SECTION 2: All ordinances and parts of ordinances related to waterworks rates and charges not amended by this Ordinance, shall remain in full force and effect.

SECTION 3: That the waterworks utility rates and charges reflected herein will become effective for all water usage beginning on July 1, 2022, on utility bills payable in August, 2022.

SECTION 4: That this Ordinance shall be in full force and effect after its passage and approval according to law or otherwise as set forth herein.

PASSED AND ADOPTED by the Common Council of the City of Scottsburg, Indiana, this 27th day of June, 2022 by a vote of 5 ayes and 0 nays.

Variance #1– Article 3.F.2, in which permitted uses in a Business 2 zoning district are “any use permitted in the B-1 District, retail uses, outdoor sales areas, as defined in Article 11, and indoor commercial recreation”. Applicant requests to use the property to develop a ministry-based men’s recovery and discipleship center where the existing building will be remodeled and three-four possible additional structures will be constructed for housing. It is proposed for up to eight students and up to two staff members to live on site.

Variance #2- Article 3.F.2, in which permitted uses in a Business 2 zoning district are “any use permitted in the B-1 District, retail uses, outdoor sales areas, as defined in Article 11, and indoor commercial recreation”. Applicant requests to construct two 1,200 square foot dwellings with concrete foundations and wooden frames. A third structure is proposed with steel beams and concrete foundation.  All zoning setbacks would be met.

Reasons necessitating the Variance: Applicant requests Variances from Development Standards for the purpose of developing a ministry-based recovery and discipleship center with staff living on-site.

NOTICE TO BIDDERS

CROTHERSVILLE, INDIANA – 2022-1 CCMG PAVING

Sealed bids will be received by the TOWN OF CROTHERSVILLE, acting by and through the TOWN BOARD (hereinafter referred to as “the Owner”), at 111 WEST HOWARD STREET, CROTHERSVILLE, IN 47229 until 10:00 AM local time, TUESDAY JUNE 26, 2022 for the construction of 2022-1 CCMG PROJECT IMPROVEMENTS for the TOWN OF CROTHERSVILLE. Bids received by the time and date specified will then be publicly opened and read aloud.

THIS PROJECT CONSISTS OF A UNIT PRICE BID FOR HOT MIX ASPHALT SURFACE OVERLAYS OF EXISTING STREETS AT VARIOUS LOCATIONS IN CROTHERSVILLE, INDIANA, AND OTHER MISCELLANEOUS AND RELATED ITEMS.

After review and award of a contract, the Owner will provide a “Notice to Proceed” to the Contractor for the specific project.  Contractor will then have 10 working days after said “Notice to Proceed” to commence construction and until November 30, 2022 to achieve Substantial Completion and December 17, 2022 to complete all work for the project.  Contractor will be assessed $300.00 a day liquidated damages for any work remaining over and above either of the specified contract completion dates.  Payment to be made on a standard monthly claim basis, with 10% retainage, and said retainage may be held up to three months after the successful completion of this contract.  There is no retainage reduction for this project.

Copies of the Contract Documents are on file for review in the Office of the Owner (TOWN OF CROTHERSVILLE – Clerk Treasurer, 111 WEST HOWARD, CROTHERSVILLE, IN 47229).  Access to an ftp site with the Contract Documents in PDF format is available from the Engineer (FPBH, Inc., 72 HENRY STREET, P. O. Box 47, North Vernon, Indiana, 47265,) for a non-refundable fee of $50.00 per set.  Printed copies of the Contract Documents are available for a non-refundable fee of $50.00 per set.  Additional sets may be purchased for a non-refundable fee of $25.00 per set.  Partial sets will not be available.  Only those plan holders registered through the Engineer will be allowed to submit a bid for the project. Requests for bid documents shall be made in writing to bidding@fpbhonline.com . Include specific project request, complete company info, address, phone numbers, and 2 email addresses for plan distribution.

Bids must be submitted on the forms in the Contract Documents and other conditions therein described must be met.  Each bid must be enclosed in a sealed envelope, clearly marked CROTHERSVILLE, INDIANA – 2022-1 CCMG PAVING on the face of the envelope and display the name and address of the bidder.  Each bid must be accompanied by a Bid Bond or Certified Check in a sum equal to 10% of the amount of the bid unless otherwise specified, and a completed Non-Collusion Affidavit.  Bid prices must be firm for a period of ninety (60) days from the bid opening date.  Should a successful bidder withdraw his bid, or fail to execute a satisfactory contract within ten (10) days after notice of acceptance of his bid, the owner may declare the Bid Security forfeited as liquidated damages, not as penalty.  The successful bidder shall furnish a Performance and Labor and Materials Payment Bond in an amount equal to one hundred percent (100%) of the contract sum with an approved surety company.  Said bond shall remain in full force and effect for a period of one (1) year after date of final acceptance of the work.

The TOWN OF CROTHERSVILLE, INDIANA, reserves the right to accept or reject any bid and to waive any or all formalities.
