LEGAL NOTICE

NOTICE OF PROPOSED RATE CHANGE BY CITY OF SCOTTSBURG, INDIANA

Notice is hereby given to ratepayers of the City of Scottsburg, Indiana (the “City”) that the Indiana Legislature has repealed the utility receipts tax levied on retail revenues of the electric utility effective July 1, 2022. Therefore, the City’s electric rates have been adjusted to remove this tax.

The Utility Receipts Tax (URT) was historically 1.4% of retail receipts and was embedded in the City’s electric rates and charges as approved in Ordinance No. 2017-9 on September 18, 2017 and Ordinance No. 2018-20 on November 5, 2018. The Indiana Legislature voted to repeal the URT and on Tuesday, March 15, 2022, Governor Eric Holcomb signed into law HEA 1002, which repeals the URT levied on retail receipts of certain utilities, including the City’s. HEA 1002 requires the City to adjust its rates and charges to reflect the repeal of the URT.

Removal of the URT results in an average decrease in the City’s electric rates of 1.4%, which in turn will result in a 1.4% decrease in adjustable operating revenues of the City’s electric utility. Actual percentage differences vary between rates and charges based on rounding of rates to two or more decimal places.

The City Council approved the 1.4% electric rate decrease in Ordinance No. 2022-8 on May 9, 2022. The change of rate will take effect for bills to be rendered beginning July 1, 2022 and billed in August 2022. Any objection should be directed to:
