The Board of Zoning Appeals of the City of Seymour, Indiana will hold a public hearing on the 26th day of April 2022 at 7 :00 p.m. at Seymour City Hall, 301-309 N Chestnut St, Seymour, Indiana (via GoToMeeting https://global.gotomeeting.com/join/384057085) on an “Application for Development Standards Variance” for real estate within the jurisdiction of the Board of Zoning Appeals. A copy of the application is on file and available for review at the Department of Planning & Zoning of the City of Seymour, Indiana.

The hearing is open to the public, all adjoining property owners, and any other interested person. Interested persons may appear and offer comments on the application at the hearing. Any person who chooses to submit written comments or objections may do so at the Department of Planning & Zoning, 301-309 N. Chestnut Street, Seymour, Indiana before 4:00 p.m. on the day of the hearing.

The name of the applicant is Timmy & Roberta Smith and the owner is the same. The affected real estate is 1402 S. O’Brien St. and front O’Brien St. The present zoning is R-1.

The applicant is requesting a variance from the required 20ft rear setback to be at 12 ft. He is wanting to install a new pool and does not have enough room in his back yard.

ADVERTISEMENT FOR BIDS

Notice is hereby given, that the City of Scottsburg, Scott County, Indiana, hereinafter referred to as the Owner, will receive sealed bid packets for the following project:

City Of Scottsburg

Moonglo Estates Subdivision

Section 2 Grissom Court

The specifications and accompanying drawings describe the work to be done and the materials to be furnished for the construction of the improvements. The project generally consists of the following:

1. Install 22’ wide roadway and cul-de-sac for Grissom Ct. Work includes grading and subgrade preparation, pavement and curb installation, and lot grading.

2. The City of Scottsburg will construct all utilities, storm sewers and detention basin. Contractor will need to coordinate roadway work with the City of Scottsburg’s utility and drainage work.

Sealed bids may be delivered or forwarded by registered mail, addressed to the City of Scottsburg, 2 E McClain Avenue, Scottsburg, Indiana 47170. Attention: Clerk Treasurer until 10:00 AM. (local time) on April 12, 2022. Bids received after such hour will be returned unopened. Each Bid must be enclosed in a sealed envelope bearing the title “City of Scottsburg Moonglo Estates Subdivision Section 2, Grissom Court” and the name and address of the Bidder. All bids must be submitted on the bid forms as identified in the Contract Documents and Specifications.

After the hour of 10:00 AM on April 12, 2022, the bids will be publicly opened and read aloud. The place of opening shall be the Scottsburg City Hall, 2 E McClain Avenue, Scottsburg, Indiana 47170.

All interested citizens are invited to attend, and should any citizens require special provisions, such as handicapped modifications or non-English translation personnel, the City will provide such provisions if the request is made by April 7, 2022.

The contract documents including plans and specifications are on file for public inspection at the following locations:

1. Scottsburg City Hall, 2 E McClain Avenue, Scottsburg, Indiana 47170.

2. Heritage Engineering LLC, at 603 N. Shore Drive, Unit 204, Jeffersonville, IN 47130.

Complete copies of the Bid Documents may be obtained by prospective Bidders from Heritage Engineering at 603 N. Shore Drive, Unit 204, Jeffersonville, IN 47130 at no charge. Bidders must be listed Plan Holders with Heritage Engineering to submit a Bid for this Project.

The work to be performed and the bid to be submitted shall include sufficient and proper sums for all general construction, labor, materials, permits, licenses, insurance, and so forth incidental to and required for installing the roadway.

The Owner reserves the right to reject any bid, or all bids, or to accept any bid or bids, or to make such combination of bids as may seem desirable, and to waive any and all informalities in bidding. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bid may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days.

A conditional or qualified Bid will not be accepted.

Award will be made to the low, responsive, responsible bidder.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Bids shall be properly and completely executed on bid forms included in the Specifications. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.

Each Bidder is responsible for inspecting the Project site(s) and for reading and being thoroughly familiar with the Contract Documents and Specifications. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid.

Notice is hereby given, that the City of Scottsburg, Scott County, Indiana by and through its City Council, hereinafter referred to as the Owner, will receive sealed bid packets for the construction of Wastewater and Water Utility Improvements, Division I – Wastewater Treatment Plant Maintenance Building, Division II – Wastewater Sewer Rehabilitation, Division III – Water Treatment Plant Clear Well Rehabilitation, and Division IV – Water Main Replacement. Sealed bids must be received by the City of Scottsburg, mailed or hand delivered to Scottsburg City Hall, 2 East McClain Avenue, Scottsburg, IN 47170, no later than 10:00 a.m. (local time) on May 4th, 2022, at which time the Bids received will be publicly opened and read. Bids will be received for a single prime Contract for each Division.

A pre-bid conference will be held at 10:00 a.m. (local time) on April 25th, 2022 at the City of Scottsburg City Hall, 2 East McClain Avenue, Scottsburg, Indiana 47170. Attendance at the pre-bid conference is highly encouraged but is not mandatory.

The Issuing Office for the Bidding Documents is: Midwestern Engineers, Inc., 6809 Corporate Dr., Indianapolis, Indiana 46278, Mark M. Sullivan, P.E., 317-334-0262. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00 a.m. – 4:00 p.m. (local time), and may obtain copies of the Bidding Documents from the Issuing Office as described below. Bidding Documents also may be examined at Scottsburg City Hall, 2 East McClain Avenue, Scottsburg, IN 47170, on Mondays through Fridays between 8:00 a.m. and 4:00 p.m. (local time).

Bidding Documents may be obtained from the Issuing Office as follows: (1) purchase by download at midwesterneng.com/planroom – $100.00 per Division, (2) purchase paper-bound Bidding Documents via in-person pick-up or via mail. The non-refundable cost of printed Bidding Documents is $300.00 per Division, payable to Midwestern Engineers, Inc. Upon receipt of payment, printed Bidding Documents will be sent via the prospective Bidder’s delivery method of choice; the shipping charge will depend on the shipping method chosen. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the prospective Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

Bid security shall be furnished in accordance with the Instructions to Bidders.

Bidders shall submit proof of qualifications to perform the Work as described in the Instructions to Bidders.

Bids shall be properly and completely executed on bid forms included in the Specifications. Bids shall include all information requested by Indiana Form 96 included with the Specifications. Under Section III of Form 96, the Bidder shall submit a financial statement. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.

No bid may be withdrawn after the scheduled closing time for receipt of bids for at least ninety (90) days. A conditional or qualified Bid will not be accepted.

Award will be made to the low, responsive, responsible bidder.

The project is being financed in part by the Indiana Finance Authority State Water Infrastructure Fund (SWIF). Contractors and subcontractors are notified that they are required to pay not less than the prevailing wage rates established by the U.S. Department of Labor and the Davis-Bacon Act. Said wage scale is included in the project Specifications.

Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. The bonds will be in the amount of 100% of the Contract Price and must be in effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.
