COMMON COUNCIL OF THE CITY OF SCOTTSBURG, INDIANA

ORDINANCE NO. 2021-33

AN ORDINANCE ESTABLISHING A NEW ARTICLE IN CITY CODE ESTABLISHING A POLICY ON MOBILE CONCESSIONS

WHEREAS, the City desires to create a policy on self-contained, mobile food and beverage services who are licensed to do business in the State of Indiana and holding all requisite health department, business and resale licensure to sell food and beverages in Indiana (“Mobile Concessions”) within the City of Scottsburg (“City”); and

WHEREAS, the City desires to create a new article in Chapter 66 of the City of Scottsburg Code of Ordinances regarding Mobile Concessions as further defined herein.

NOW, THEREFORE, BE IT HEREBY ORDAINED by the Common Council of the City of Scottsburg, Indiana:

1. NEW ARTICLE. A new article is hereby added to Chapter 66 of the City Code entitled “Mobile Concessions” and shall read as follows:

ARTICLE IV. MOBILE CONCESSIONS

Sec. 66-70. DEFINITIONS. For purposes of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.

MOBILE CONCESSIONS. Self-contained, mobile food and beverage services licensed to do business in the State of Indiana and holding all requisite health department, business and resale licensures to sell food and beverages in Indiana. This term shall not include food delivery services that deliver food or beverages ordered by a purchaser to a specific address provided by the purchaser.

Sec. 66-71. PERMIT DISPLAY. Owners or operators of a mobile concessions business shall always display the permit obtained by the County Health Department while operating within the city.

Sec. 66-72. MOBILE CONCESSION OPERATIONS. Mobile Concessions businesses shall not:

a) Interfere with or obstruct the free passage of pedestrians or vehicles along any street, sidewalk, road or parking lot drive aisle;

b) Park in a manner that obstructs or interferes with the free flow of traffic at any intersection; or

c) Locate for the purposes of doing business in any parking lot, parking space, right-of-way, or parking facility owned, leased or managed by the City unless approval has been given by the Common Council or is a part of a City approved event or festival.

Mobile Concession businesses shall seek permission from the property owner to be located on private property.

Sec. 66-73. COMPLIANCE WITH LAWS, REGULATIONS AND ORDINANCES. Mobile concessions must comply with all local, state and federal laws, regulations and ordinances. Mobile concessions will be responsible for collecting the proper sales and food and beverage taxes and reporting to the proper state agencies.

Sec. 66-74. FIRE PROTECTION REQUIREMENTS.

1) Mobile concessions which provide services within the fire protection area of the City of Scottsburg Fire Department shall be equipped with proper fire extinguishing equipment. Such equipment shall be properly installed and maintained to the State of Indiana Fire Code and/or the appropriate NFPA standards. This shall include, but is not limited to, all fire extinguishers, grease laden vapor systems and compressed gas for cooking.

b) Inspections. All mobile concessions providing services within the fire protection area of the City of Scottsburg Fire Department may be subject to inspection by the Fire Department at any time the mobile concession is operating within the city, to ensure compliance with this section.

c) The City of Scottsburg Fire Department shall have authority to enforce this section.

Sec. 66-75. PENALTY. Any person, firm or corporation who violates any section of this chapter shall be subject to a fine of fifty dollars ($50.00). Each day such violation is committed or permitted to continue shall constitute a separate offense. A second violation in any twelve-month period is subject to a fine or penalty of one hundred dollars ($100.00) and subsequent violations within a twelve-month period are subject to a fine or penalty of five hundred dollars ($500.00).

2. NO CONFLICT. All ordinances, resolutions, and orders (or parts thereof) that conflict with the provisions of this Ordinance hereby are repealed to the extent of such conflict.

3. SEVERABILITY. If any section, paragraph, or provision of this Ordinance is held to be invalid or unenforceable for any reason, then the invalidity or unenforceability of such section, paragraph, or provision shall not affect any of the remaining provisions of this Ordinance.

4. EFFECTIVENESS. This Ordinance shall be in full force and effect from and after its passage.

Purposed Superintendent Contract

Notice is hereby given that the Board of School Trustees of Scott County School District 1, Austin, Indiana proposed to enter into a contract with the Superintendent of Schools. The proposed details of the contract will be discussed at a Public-School Board Meeting to be held at the Scott County School District 1 Board Room, located at 255 Highway 31 South, Austin, Indiana 47102 at 6:30 PM on January 10, 2022. The board will discuss and hear objections to and support for the proposed contract. The proposed contract, if approved, will have a base salary of $117,420 effective February 1, 2022 – January 31, 2025. In addition, the board shall increase the annual base salary of the Superintendent by an amount equal to the pay increases given to the school administrators in any given year and to the family insurance premium provided to all SCSD 1 school administrators per school board policy. The current benefits package is valued at $36,339.56 annually. The Superintendent’s performance must be rated highly effective or effective in order to receive any increases.
