AN ORDINANCE AMENDING THE SCHEDULE OF RATES AND CHARGES COLLECTED BY THE SCOTTSBURG DEPARTMENT OF WATERWORKS AND ESTABLISHING NEW RATES AND CHARGES FOR THE SCOTTSBURG DEPARTMENT OF WATERWORKS AND OTHER MATTERS CONNECTED THEREWITH

WHEREAS, the Board of Directors of the Department of Waterworks of the City of Scottsburg, Indiana, has determined that the present rates and charges for the use of, and services rendered by, the waterworks of Scottsburg are insufficient to enable the City to properly operate its waterworks plant, to provide for depreciation, operation and maintenance and sinking fund requirements, and to provide for future capital improvements for the existing waterworks system of the City of Scottsburg, Indiana, and that said existing rates and charges should be increased, and,

WHEREAS, the Board of Directors of the Department of Waterworks of the City of Scottsburg, Indiana, has adopted its Resolution No. 2021-R–3 recommending certain rates and charges be established for water service to customers served by the Scottsburg Water Utility, subject to the approval thereof by the Common Council of the City of Scottsburg, Indiana, and

WHEREAS, the Common Council now desires to adopt said Resolution in part, and now therefore;

BE IT HEREBY ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SCOTTSBURG:

Section 1. Resolution No. 2021-R-3, which was passed by the Board of Directors of the Department of Waterworks of the City of Scottsburg on the 9th day of August, 2021, is hereby adopted in part. The Common Council desires to review rates and charges on an annual basis without automatic increases. Annually the Common Council shall review the operating expenses of, the capital costs of, and the revenues from the water utility received as compared to projections. The Common Council will then determine, after input from the Board of Directors of the Department of Waterworks of the City of Scottsburg, Indiana and the public, if the water rates for the coming year should be modified based on revised conditions in order to maintain proper service to the citizens of Scottsburg.

Section 2.  The rates and charges for the Scottsburg Department of Waterworks shall be as established and set forth in the Exhibit “A” to this ordinance, which is attached hereto, and incorporated herein.

Section 3. All schedules of rates and charges in conflict herewith are hereby superseded; provided, however, that the existing schedule of rates and charges shall remain in full force and effect through the billings submitted to water utility customers on or about December 1, 2021, and the new rates and charges shall be reflected in the water utility billings submitted to customers on or about January 1, 2022.

Section 4. All ordinances and parts of ordinances, including Ordinance No. 2019-2, in conflict herewith are repealed.

Section 5. This ordinance shall be in effect upon its adoption and approval by the Mayor.

(c) LATE PAYMENT CHARGES

Bills unpaid fifteen (15) days following the due date, as stated on such bills, shall be subject to a collection charge of 10% on the first $3.00 of unpaid billing and 3% on the balance of the unpaid billing in excess of $3.00.

(d) RECONNECTION CHARGES           $50.00

Notice is hereby given that the City of Austin Redevelopment Commission will receive requests for proposals until 1:00 p.m. local time on Friday, November 12, 2021, at 82 West Main Street, Austin, Indiana 47102 concerning the lease, purchase, and/or development of the real estate located at 49 N. High St. and 60 W. Main St. in Austin, Indiana.  Proposals shall be in accordance with I.C. 36-7-14-22 and the Request for Proposals guidelines.
