LEGAL NOTICE
Legal Notice of Public Hearing
Notice is hereby given that the Scott County Board of Zoning Appeals will hold a public hearing at the Scott County Courthouse 1 E. McClain Avenue, Room 128, Scottsburg, IN on Wednesday, November 10, 2021, at 6:00 PM at which time all interested persons will be given the opportunity to be heard in reference to the matters set out in the “Description of Action Requested” below:
Case Number: V-11-21
Applicant(s): Richard M. Combs
Owner(s): Richard M. Combs
Present Zoning: A – Agriculture
Description of Action Requested: Owner wishes a variance which will allow him to rebuild a barn sitting closer to the road and a side property line than is allowed by the Scott County Zoning Ordinance under Article 3.A.5.c.1.2.
Description of Property Affected: 72-09-05-400-020.000-007 being cka 3924 South Underwood Road, Scottsburg, IN, and containing 0.87 acre.
Reason(s) necessitating request: Size of said property is grandfathered, but, because of its size, applicant needs a variance to allow his new barn to be located within the 30-foot setbacks on north side property line and within the 65-foot setback from the center line of the county road. His plans call for tearing down the present barn and building a larger barn which he plans to put in the present setback line as the house, approximately 50 feet. Setback from side property line will be 25 feet. Building the new barn over the footprint of the old barn will allow him to use the same driveway and will not disturb his septic tank and field.
The petition (application) and file on this matter are available for public inspection during the regular working hours of the Scott County Courthouse, 1 E. McClain Avenue, burg, IN, Suite G40 until two business days prior to the hearing date. (812-752-8445, ext. 1)
