State Revolving Fund (SRF) Loan Program Categorical Exclusion (CE):  Jackson County Water Utility, Inc., Jackson County, Brownstown Township, PER:  Watermain and Lead Service Line Replacement in Brownstown; SRF Project DW 21 03 36 04.

To all interested parties:  this is notification that the Jackson County Water Utility, Inc. watermain and lead service line replacement in Brownstown project is categorically excluded from substantive environmental review.  The SRF is submitting the CE for public notice.

Replacing existing water mains in order to improve the quality of the existing distribution system that is partially comprised of lead components.  The proposed project will serve to protect human health and ensure households have a safe water supply. Replacement of water main, service lines and water meters in the Town of Brownstown along Spring Street, N. High Street, Walnut Street, Stout Street, Stillwell Street, Asher Street, and the Courthouse square.

Total cost of this project is estimated to be approximately $4,211,000.  The Jackson County Water Utility, Inc. will finance the project with a loan from the SRF Loan Program for a term and annual fixed interest rate to be determined at loan closing.  Monthly user rates and charges may need to be analyzed to determine if adjustments are required for loan repayment.

On or about August 27, 2021, the City of Austin applied to the Indiana Office of Community and Rural Affairs for a grant from the State Community Development Block Grant (CDBG) program. This program is funded by Title I of the Housing and Community Development Act of 1974, as amended. These funds are to be used for a community development project which includes a Housing Owner-Occupied Rehab Program with the following activities: Rehabilitation of scattered owner-occupied homes within Austin. The total amount of CDBG funds to be awarded is $225,000.00. The amount of CDBG funds proposed to be used for activities that will benefit to low- and moderate-income persons is approximately $215,000. The Applicant also proposed to expend an estimated $25,000 in non-CDBG funds on the project. The non-CDBG funds will be derived from the City of Austin’s general fund.

The City of Austin will hold a public hearing on Tuesday October 26, 2021 at 10:00 am., at the Austin Town Hall, Meeting Room, 82 W. Main St., Austin, Indiana, to provide interested parties an opportunity to express their views on the proposed federally funded CDBG project. Persons with disabilities or non-English speaking persons who wish to attend the public hearing and need assistance should contact the Clerk Treasurer’s office located at 82 W. REQUEST FOR PROPOSALS

CITY OF AUSTIN

The City of Austin, Indiana, requests proposals for the provision of grant administration technical assistance services appropriate to the implementation of a grant from the Indiana Office of Community and Rural Affairs grant program using federal Community Development Block Grant funds allocated by the U.S. Department of Housing and Urban Development (HUD). This program is funded by the Title I of the Housing and Community Development Act of 1974, as amended.

Description of Services Needed

Services should include; environmental review; financial records management; labor standards; project reporting and close-out.

Type of Contract

The City of Austin will execute a fixed price type of contract for these services that is contingent on the final commitment of grant funding.

Federal Requirements

Prospective offerors should note the successful proposer must meet the following terms and conditions:

1. 24 CFR Part 85.36.

2. Title VI of the Civil Rights Act of 1964.

3. Conflict of Interest (24 CFR Part 570).

4. Access to records.

5. Executive Order 11246 – Equal Employment Opportunity

6. Executive Order 12138 – Women Business Enterprise Policy.

7. Architectural Barrier Act of 1968.

8. Age Discrimination Act of 1975.

9. Section 3 Clause – Housing and Urban Development Act of 1968.

The Indiana Office of Community and Rural Affairs has a 10% MBE/WBE goal for all projects funded with Community Development Block Grant funds.

Rate of Proposals/Qualifications

The proposal must include sufficient information regarding qualifications and determine that the grant administrator is qualified and experienced.  The proposal should include the following:

1. A description of expertise, experience and resources directly relevant and available for the proposed project.

2. A list of similar projects previously completed.

3. Resumes of professional staff members that will work on this project.

4. Name of person to be in charge of project.

5. Description of scope of services as per Description of Services Needed and proposed prices as per Type of Contract.

The proposal shall also provide the following information:

Name, title, address and telephone number of individuals with authority to negotiate and bind the proposer contractually, and who may be contacted during the period of proposal evaluation.

Award of Contract

Proposal Evaluation criteria shall include:

1. Specialized experience or technical expertise of the organization and its personnel in connection with the scope of services to be provided and complexity of the project. (30 pts)

2. Past record of performance on contracts, including quality of work, timeliness and cost control. (20 pts)

3. Capacity of the organization to perform the work within time limitations, taking into consideration the current planned workload of the firm. (15 pts)

4. Familiarity of the organization with this type of project or problems applicable to the project. (25 pts)

5. Fees. (10pts)

If you are interested in providing the required services, proposals must be received by the Office of the Mayor, 82 W. Main Street, Austin, IN 47102 by the close of business on October 29, 2021. Proposals received after this time will be returned unopened.  Each Proposal will be reviewed for completeness and clarity according to the above criteria. The proposal must be submitted in writing in a sealed envelope labeled “Administration Proposal”.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAMS

On or after October 21, 2021 the City of Austin will submit a request to the Indiana Office of Community and Rural Affairs for the release of Community Development Block Grant Entitlement funds under Title I of the Housing and Community Development Act of 1974 as amended, to undertake the following project:

Tier 1 Broad Review Project/Program Title: City of Austin Owner-Occupied Rehabilitation Program.

Purpose: The program will assist in the rehabilitation of approximately 15 homes for income qualified homeowners.

Location: The owner-occupied housing units will be located withing the incorporated boundaries of the City of Austin.

Project/Program Description: The project is a scattered site rehabilitation of owner occupied housing units.  The rehabilitation consists primarily of roofing replacement, HVAC replacement, electrical upgrades, water heater replacement and accessibility modifications to the threshold of the home for income qualified homeowners residing within the corporate limits of Austin, IN.  Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Level of Environmental Review Citation: The categorical exclusion citation under which the City of Austin’s Rehabilitation Program of home-owner occupied single family homes is: “24 CFR Part 58.35(a)(3)(i)”

Tier 2 Site Specific Review: The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: The site specific reviews will cover the following laws and authorities not addressed in the Tier 1 Broad Level Review including: Airport Hazards, Flood Insurance, Floodplain Management and Section 106 Historic Properties Review.

Mitigation Measures/Conditions/Permits (if any): For the laws and authorities listed in the Tier 2 site specific review will address the issues as follows: Airport Hazards, map with location of site to determine applicability; Flood Insurance, property owner will be requested to provide insurance of property and program administrator will determine if flood insurance is required; Floodplain Management, map with location of site will be obtained from FEMA or DNR – Division of Water; and historic properties-Section 106 Review of the site will be conducted including correspondence with the Indiana Department of Natural Resources, State Historic Preservation Officer.

Estimated Project Cost: $250,000.

The activity/activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.5(a)(3)(i). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Austin City Hall, Mayor’s Office, 82 W. Main Street, Austin, IN 47102 and may be examined or copied weekdays 8:00 A.M to 4:00 P.M., Monday through Friday.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Austin City Hall, Mayor’s Office, 82 W. Main Street, Austin, IN 47102. All comments received by October 20, 2021 will be considered by the City of Austin prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL CERTIFICATION

The City of Austin certifies to the Indiana Office of Community and Rural Affairs (OCRA) that Roger Hawkins, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Austin to use HUD program funds.

OBJECTIONS TO RELEASE OF FUNDS

The State will accept objections to its release of fund and the City of Austin certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Austin; (b) the City of Austin has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to OCRA, Environmental Officer, One North Capitol, Suite 600, Indianapolis, IN  46204-2288.  Potential objectors should contact OCRA, Environmental Officer, to verify the actual last day of the objection period.
