NOTICE OF ADOPTION OF AN ORDINANCE ESTABLISHING THE WASTEWATER DEPOSIT AMOUNT FOR THE TOWN OF CROTHERSVILLE,

INDIANA

Taxpayers, property owners, and other interested parties in the Town of Crothersville, Indiana (“Town”) are hereby notified that the Town Council adopted an ordinance establishing the wastewater deposit amount for the Town of Crothersville. The effective date of the ordinance is October 3, 2023.

ORDINANCE NO. 2023-6

AN ORDINANCE OF THE TOWN COUNCIL

OF THE TOWN OF CROTHERSVILLE, INDIANA

ESTABLISHING THE WASTEWATER DEPOSIT AMOUNT

WHEREAS, the Town of Crothersville, Indiana (“the Town”) has established, constructed, and financed a municipal water and sewer works in accordance with the provisions of Indiana Code § 8-1.5-3, as amended (the “Act”), for the purpose of providing water and for the collection and treatment of sanitary wastes in and around the Town; and

WHEREAS, the Crothersville Town Council (“Town Council”) has determined that it is necessary and proper to set a wastewater deposit fee (“deposit”) of Seventy-Five dollars ($75.00) for all new applicants or customers prior to beginning service.

NOW, THEREFORE, BE IT ORDAINED, ORDERED, AND RESOLVED by the Town Council of the Town of Crothersville, Indiana, as follows:

Section 1. The deposit fee for any party desiring to set up a new wastewater account with the Town of Crothersville shall be Seventy-Five dollars ($75.00) per new account. These fee(s) shall be borne by the customer under whose name the account will be opened.

Section 2. After notice to the Town that its service is no longer needed, a deposit made for wastewater service that is no longer in use shall be refunded to the party making the deposit within one year from the date of payment of the final bill, provided that the party responsible for the wastewater bill has made the final payment and there is no outstanding balance. In the event there is an outstanding balance, then the deposit shall be credited to the final bill.

Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed.

Section 4. This ordinance shall be in full force and effect from and after its passage and execution by the Town Council.

SIDEWALK IMPROVEMENTS PHASE II

The specifications and accompanying drawings describe the work to be done and the materials to be furnished for the construction of the improvements. The project generally consists of the following:

1. Remove and replace existing sidewalks within the City of Scottsburg which include demolition and removal of existing sidewalk debris, grading and subgrade preparation, and replacement of sidewalks.

Sealed bids may be delivered or forwarded by registered mail, addressed to the City of Scottsburg, 2 E McClain Avenue, Scottsburg, Indiana 47170. Attention: Clerk Treasurer until 10:30 AM. (local time) on October 30, 2023. Bids received after such hour will be returned unopened. Each Bid must be enclosed in a sealed envelope bearing the title “City of Scottsburg Sidewalk Improvements Phase II” and the name and address of the Bidder. All bids must be submitted on the bid forms as identified in the Contract Documents and Specifications.

After the hour of 10:30 AM. (local time) on October 30, 2023, the bids will be publicly opened and read aloud. The place of opening shall be the Scottsburg City Hall, 2 E McClain Avenue, Scottsburg, Indiana 47170.

All interested citizens are invited to attend, and should any citizens require special provisions, such as handicapped modifications or non-English translation personnel, the City will provide such provisions if the request is made by October 25, 2023.

The work to be performed and the bid to be submitted shall include sufficient and proper sums for all general construction, labor, materials, permits, licenses, insurance, and so forth incidental to and required for installing the roadway.

The Owner reserves the right to reject any bid, or all bids, or to accept any bid or bids, or to make such combination of bids as may seem desirable, and to waive any and all informalities in bidding. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bid may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days.

A conditional or qualified Bid will not be accepted.

Award will be made to the low, responsive, responsible bidder.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Bids shall be properly and completely executed on bid forms included in the Specifications. The Owner may make such investigations as deemed necessary to determine the ability of

the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.

Each Bidder is responsible for inspecting the Project site(s) and for reading and being thoroughly familiar with the Contract Documents and Specifications. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid.
