AN ORDINANCE AMENDING CHAPTER 86, ARTICLE VI OF 

THE CITY OF SCOTTSBURG, INDIANA CODE OF ORDINANCES 

REGULATING ABANDONED VEHICLES

Notice is hereby given that the Common Council of the City of Scottsburg, Indiana, at a regular meeting held on November 4, 2024, adopted Ordinance No. 2024-20, an ordinance regulating abandoned vehicles within the city limits. The Ordinance establishes standards for identifying, removing, and disposing of abandoned vehicles to promote public safety and maintain community aesthetics. Key provisions of the Ordinance include:

1. Definition of Abandoned Vehicles – The ordinance provides criteria for classifying a vehicle as abandoned, including, but not limited to, vehicles left unattended on public or private property without consent for an extended period or those in a state of disrepair or unserviceable condition.

2. Removal and Impoundment – Procedures for the removal and impoundment of vehicles deemed abandoned are outlined, allowing authorized City personnel to remove such vehicles and store them at designated facilities.

3. Notice to Owners – Owners of abandoned vehicles will be notified in accordance with the ordinance, giving them an opportunity to reclaim the vehicle before disposal.

4. Fees and Penalties – The ordinance includes a fee schedule for the removal and storage of abandoned vehicles, as well as potential fines for violations of the ordinance.

5. Disposal of Unclaimed Vehicles – The ordinance outlines procedures for disposing of vehicles not reclaimed within the required timeframe, in compliance with state law.

This ordinance is effective as of November 13, 2024. Violations of the ordinance may result in the towing of abandoned vehicles, fines, fees, and other penalties. AN ORDINANCE ESTABLISHING TAMPER AND AFTER HOUR FEES FOR THE CITY OF SCOTTSBURG DEPARTMENT OF WATERWORKS 

Notice is hereby given that the Common Council of the City of Scottsburg, Indiana, at a regular meeting held on November 4, 2024, adopted Ordinance No. 2024-19, an ordinance establishing a tamper fee and an after-hours connection fee for services provided by the City of Scottsburg Department of Waterworks. The Ordinance aims to recover costs associated with unauthorized tampering of water services and after-hours service requests. Key provisions of the Ordinance include:

1. Tamper Fee – A $250 fee will be imposed for unauthorized tampering with water meters, equipment, or other water infrastructure maintained by the City. This fee is intended to deter tampering and cover costs associated with repairs and maintenance resulting from unauthorized actions.

2. After-Hours Connection Fee – A $150 fee will apply for water service connections requested outside of normal operating hours. This fee is designed to cover the additional costs incurred by the Department of Waterworks for after-hours service.

3. Fee Schedule – The ordinance includes a fee schedule specifying the amounts for the Tamper Fee and After-Hours Connection Fee.

NOTICE OF PRELIMINARY DETERMINATION OF 

CROTHERSVILLE COMMUNITY SCHOOLS

Owners of real property, and registered voters residing in, the School District of the Crothersville Community Schools (the “School Corporation”), are hereby given notice that the Board of School Trustees of the School Corporation (the “Board”), having held meetings and two separate public hearings pursuant to Indiana Code 6-1.1-20-3.1 and Indiana Code 5-3-1, on November 4, 2024, at 5:00 p.m. at the School Corporation’s Central Office at 201 South Preston Street, Crothersville, Indiana 47229, adopted a resolution (the “Resolution”) making a preliminary determination to undertake (a)(i) comprehensive HVAC upgrades, renovations, replacements and repairs at all school corporation facilities, (ii) related heating, cooling, air handler system and chiller repairs, equipping and upgrades, (iii) boiler repairs, replacements and upgrades, (iv) related plumbing and electrical renovations, (v) cafetorium sound system upgrades and improvements, (vi) fire alarm upgrades, (vii) parking lot repairs, and (viii) other replated repairs, upgrades and renovations (items ((i) through (viii) collectively, the “Project”), and (b) to the extent permitted by law to take all of the necessary steps to finance all or a portion of the costs of the Project by issuing general obligation bonds of the School Corporation (the “Bonds”).  

The total maximum original aggregate principal amount of the Bonds will not exceed $375,000.  The Bonds will mature not later than January 15, 2027.  Based on the estimated interest rates that will be paid in connection with the Bonds of 6.00% per annum, the total interest cost associated therewith will not exceed $18,825, not taking into account any funds of the School Corporation being available for capitalized interest.  The School Corporation’s certified total debt service fund tax levy for 2024 (which is the most recent certified tax levy) is $904,895 and the School Corporation’s debt service fund tax rate for 2024 (which is the most recent certified tax rate) is $0.5553 per $100 of assessed value.  The School Corporation’s estimated total debt service fund tax levy for 2025 is $1,113,710 and the School Corporation’s estimated debt service fund tax rate for 2025 is $0.6050 per $100 of assessed value.  The estimated total maximum debt service fund tax levy for the School Corporation and the estimated total maximum debt service fund tax rate for the School Corporation after the issuance of the Bonds are anticipated to occur no earlier than 2025 and will be $1,113,710 and $0.6050 per $100 of assessed value, respectively, as a result of the payment of the debt service on the Bonds.  

The estimated amount of the School Corporation’s debt service levy and rate that will result during the following 10 years if the School Corporation issues the Bonds, after also considering any changes that will occur to the debt service levy and rate during that period on account of any outstanding bonds or lease obligations that will mature or terminate during that period is as follows:

The result of the School Corporation’s current and projected annual debt service payments divided by the net assessed value of taxable property in the School Corporation is 0.6050%.  The result of the sum of the School Corporation’s outstanding long-term debt plus the outstanding long-term debt of other taxing units in the School Corporation divided by the net assessed value of taxable property in the School Corporation is 3.94%.

Any owners of real property within the School District of the School Corporation and/or registered voters residing in the School District of the School Corporation who want to initiate a petition and remonstrance process against the proposed debt service for the Bonds must file a petition requesting the application of a petition and remonstrance process with the Jackson County Voter Registration Office which complies with Indiana Code 6-1.1-20-3.1 not later than thirty (30) days after the date of publication of this notice.

NOTICE OF SALE OF TEMPORARY LOAN WARRANTS OF

SCOTT COUNTY SCHOOL DISTRICT 2

Notice is hereby given that the Board of School Trustees of Scott County School District 2 (the “School Corporation”), on December 4, 2024, at 11:00 a.m. (Indianapolis Time) at the School Corporation c/o Therber & Brock, 11550 North Meridian Street, Suite 275, Carmel, Indiana, 46032, or by e-mail: mike.therber@therberbrock.com, will receive sealed or e-mailed bids on the following defined and described Warrants:

Temporary loan warrants in anticipation of taxes levied in the maximum amount of $2,500,000 for the Operations Fund (the “Warrants”) of the School Corporation; dated as of the date of delivery thereof to the purchaser or purchasers; in minimum denominations of $100,000 and any integral multiple of $5,000 in excess thereof, maturing on December 31, 2025, with interest at a rate to be determined by bidding, payable at maturity of the Warrants.  Bidders shall submit bids that allow the School Corporation to receive payment of the Warrants in multiple draws over time with interest accruing from the dates of each such draw made on the Warrants.  Interest shall be calculated on a 365-day basis.  Principal and interest will be payable at the office of the Treasurer of the School Corporation.  It is anticipated that the Warrants will be delivered on or about January 2, 2025.

No bids for less than the par amount of the aforementioned Operations Fund will be considered, with such par amount to be confirmed by the School Corporation prior to the acceptance of bids.  The maximum interest rate on the Warrants shall not exceed 5.00% per annum.  The interest rates shall be stated as a fixed rate and as a multiple of 1/100 of 1% or 1/8 of 1%.  The Warrants shall be awarded to the lowest responsible and responsive bidder and/or bidders submitting the lowest net interest rate or rates after deducting therefrom the premium bid, if any, for the Warrants or portion thereof bid for.  In calculating the net interest cost to the School Corporation, bids submitted reflecting that the School Corporation will receive payment of the Warrants in multiple draws will be evaluated by assuming that the full amount of the loan evidenced by such Warrant is drawn on the date of delivery of such Warrant.  The right is reserved to reject any and all bids and to deliver less than the whole issue if an approving opinion of counsel cannot be obtained covering the whole issue.  If acceptable bids are not received on the sale date covering the Warrants, the sale of the unpurchased portion thereof may be continued from day to day thereafter, not exceeding thirty (30) days without readvertisement of the sale.   

Each bid must be enclosed in a sealed envelope addressed to the School Corporation and marked on the outside “Bid for Scott County School District 2 Temporary Loan Warrants” or e-mailed to the e-mail address above at or prior to the aforementioned date and time for receipt of such bids.  At the time of delivery, the successful bidder will be required to deliver an investment letter in satisfaction of state and federal securities laws.  The Warrants are being issued under the exception enumerated under subsection (d)(1) to SEC Rule 15c2-12; therefore, no offer will be accepted unless any such offeror agrees that it will not sell, transfer, assign or otherwise dispose of the Warrants or such ownership interests therein.

The Warrants are being issued under the provisions of Indiana Code, Title 20, Article 48, Chapter 1, to evidence a temporary loan for the purpose of obtaining funds to be used for the aforementioned fund to meet expenses of the School Corporation included in the regular budget and appropriations adopted for the year 2025, which expenses must be met prior to the settlement and distribution of taxes in the year 2025.  There has been appropriated and pledged a sufficient amount of current revenues of the School Corporation to be derived from the levy for the aforementioned fund on account of the taxes for the year 2024, payable in 2025, for the payment of principal and interest of the Warrants at maturity, as verified by Scott County Auditor’s Office.

The Warrants are being issued under the exception enumerated under subsection (d)(1) to SEC Rule 15c2-12; therefore, no Official Statement and no Continuing Disclosure Undertaking Agreement will be delivered to the purchaser or purchasers of the Warrants.

The approving opinion of Ice Miller LLP, Bond Counsel, of Indianapolis, Indiana, covering the legality of such Warrants will be furnished to the purchaser or purchasers at the School Corporation’s expense, together with the usual closing certificates and a transcript of the legal proceedings.  No conditional bids shall be considered.  The successful bidder or bidders shall accept delivery of the Warrants and make payment therefor at the office of the Treasurer of the School Corporation.
