A rural Scott County man was charged Oct. 9 with driving under the influence and possession of a firearm on school property while waiting to pick up his grandson .

John S. Case, 63, of the 5000 block of White Tail Lane in Lexington Township was charged following the incident.

According to Scott County Deputy Kyle West he was notified by the Johnson Township Elementary School resource officer that there was a man drinking alcohol while waiting in the school pick up line.

As the resource officer approached the man’s vehicle he saw the man, later identified as Case, toss a beer can into the passenger side of the vehicle, according to the probable cause affidavit.

Deputy West conducted field sobriety tests on Case which Case failed, the deputy reported. Deputy West reported that when a certified breath test was administered, Case tested .145; the legal limit for intoxication is .08.

Case later told the deputy that he drank two Bud Light tall boy cans at home around 1 p.m. and drank another tall can on the way to Johnson Elementary to pick up his grandson, according to the court document.

Officers began searching Case’s vehicle where they found a loaded handgun in the vehicle console. Case told officers that he knew the handgun was in the vehicle “but thought since he had a handgun permit he could take his handgun anywhere,” the court document read.

After being booked into Scott County Jail, Circuit Court Magistrate Alison Frazier set Case’s bond at $15,000.
