Notice is hereby given that the Common Council of the City of Austin, Indiana (the “Council”) will conduct a public hearing on Tuesday, May 14, 2024 at 5:00 p.m. local time at Austin City Hall, 80 West Main Street, Austin, Indiana 47102 regarding and to consider adopting an ordinance making a preliminary determination for the Council to approve the entering into of a proposed lease between the Austin Building Corporation (the “Building Corporation”), a nonprofit building corporation, as lessor, and the City of Austin, Indiana (the “City”), as lessee (the “Lease”). The Lease will be entered into in connection with the financing of the construction, installation, and/or acquisition of certain photovoltaic solar energy arrays to serve the City’s wastewater treatment plant (the “Project”). The Lease will also finance all or a portion of the expenses incurred in connection with or on account of the issuance of bonds by the Building Corporation. The City’s lease payments under such Lease will be payable from all legally available revenues of the City.

At the public hearing, the Council will hear any objections to and support for the proposed Project and the proposed Lease from the general public.
