On or about October 20, 2023, the City of Austin intends to begin the application process with a submission of a grant proposal to the Indiana Office of Community and Rural Affairs for a grant from the State Community Development Block Grant (CDBG) Stormwater Improvements Program; the full applications are due December 22, 2023.This program is funded by Title I of the Housing and Community Development Act of 1974, as amended. These funds are to be used for a community development project that will include the following activities: Drainage improvements in designated areas of the city to reduce flooding and erosion. The proposed project includes regrading existing ditches with adequately sloped paved ditch or piping to provide positive drainage. New driveway culverts will be constructed where needed. In addition, an earthen berm will be constructed along Kenwood Drive and Tibbs Street. The total amount of CDBG funds to be requested is $600,000.00. The amount of CDBG funds proposed to be used for activities that will benefit low-to moderate-income persons is approximately $313,920.00. The Applicant also proposes to expend an estimated $178,000.00 in non-CDBG funds on the project. These non-CDBG funds will be derived from the following sources: City of Austin Tax Increment Finance funds.

The City of Austin will hold a public hearing on Tuesday, October 10, 2023, at 6:00 p.m. or as soon as possible following the City of Austin Board of Works meeting allows in the Austin Council Chambers, 82 W. Main Street, Austin, Indiana to provide interested parties an opportunity to express their views on the proposed federally funded CDBG project. NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the City of Scottsburg Advisory Plan Commission (the “Plan Commission”) will conduct a hearing on a Uniform Development Ordinance (the “UDO”), as the proposed replacement to the 2004 Scottsburg Zoning Ordinance and 2004 Subdivision Control Ordinance, pursuant to the provisions of Ind. Code § 36-7-4-600, et seq. The hearing will be conducted on Tuesday, October 10, 2023, at 4:30 p.m., in the City Council Chambers in Scottsburg City Hall, 2 East McClain Avenue, Scottsburg, Indiana. The UDO will apply to a geographic area that includes all lands within the existing corporate boundaries of the City of Scottsburg, as well as that portion of the 2-mile fringe area in the unincorporated territory of Scott County over which the Plan Commission has previously asserted jurisdiction in accordance with Ind. Code § 36-7-4-205.

Chapter 7 of the proposed UDO contains or would add or amend penalty or forfeiture provisions, the entire text of which read as follows:

Any person who violates or fails to comply with any provisions of this UDO shall be guilty of an ordinance violation and shall be fined, per violation, up to the maximum amount permitted by state law. Each day a civil violation remains uncorrected shall be a distinct and separate violation subject to an additional fine. If the jurisdiction is required to institute legal action to enforce this UDO, or to collect a fine thereunder, the violator shall also be responsible for the jurisdiction’s reasonable attorney fees and all costs related to the enforcement or collection.

A complete copy of the proposed UDO is on file and available for public examination before the hearing during regular business hours in the Plan Commission office at Scottsburg City Hall, 2 East McClain Street, Scottsburg, Indiana 47170.

Written objections to the proposal that are filed with the Secretary of the Plan Commission before the hearing will be placed in the hearing record and considered by the Plan Commission. Oral comments concerning the proposal will be heard from all interested parties during the public hearing.

Subsequent to the closing of the public hearing, the Plan Commission may certify the proposal with a favorable recommendation to the Scottsburg City Council pursuant to the provisions of Ind. Code § 36-7-4-605(a)(1). The hearing may be continued from time-to-time as found necessary by the Plan Commission.

LEGAL NOTICE

ADVERTISEMENT FOR BIDDERS

Sealed Bids for the “Total Concepts of Design Lift Station Project” for the Scott County Regional Sewer District (herein called the “OWNER”) will be received by the Owner at the Auditor’s Office, located in the Scott County Courthouse, 1 E. McClain Ave, Scottsburg, IN 47170 until October 6, 2023, at 1:00 p.m. (local time). Any Bids received later than the above time will be returned unopened. All Bids will be publicly opened and read aloud at that time, in the Commissioner’s Room, located in the Scott County Courthouse.

The Work shall include:

Installation of approximately 2,860 LF of 6-inch SDR 21 Force Main, plus or minus 68 LF of 8inch SDR 35 gravity sewer; demolition of an existing tank in the Total Concept Mound System, a sanitary manhole, a 6-foot diameter pre-cast lift station and valve vault and all other necessary equipment required to construct the Project as presented in the construction drawings. Bid shall include all implicit and explicit labor, equipment, and ancillary items required to develop a fully functional system.

Work shall be constructed under a Unit Price Contract.

Bids shall be properly and completely executed on a State Board of Accounts Form 96 (Revised 2013). Each Bid shall be accompanied by the Contractor’s Bid Attachment (included with the Contract Specifications) to Form 96, a Financial Statement (completely filled out and signed) and a bid security in the form of an acceptable certified check payable to the Owner or an acceptable Bidder’s bond, in an amount of not less than 5 percent of the total bid price, in accordance with the Contract Specifications. Any bid not accompanied by the above required items shall be deemed to be a nonresponsive bid by the Owner. No consideration of price escalation will be given; therefore, Contractors are advised not to include any such escalation clauses in their proposal for this Project. Any contract or contracts awarded under this Advertisement for Bids is expected to be funded by a State Revolving Fund (SRF) Loan, administered by the Indiana Finance Authority (IFA). The Contractor to whom the work is awarded shall comply with all requirements of said agencies. Where conflict exists between this Specification and the agency specifications, the more stringent shall apply.

The SRF program has participation goals for minority (MBE), and women owned (WBE) business enterprises. As this Project is funded by the SRF, the Contractor is expected to comply with all applicable MBE/WBE participation requirements. The Contractor is required to show a positive effort for MBE/WBE solicitation. The SRF goals are: MBE – 7.0 percent WBE – 5.0 percent. Contractors and subcontractors are required to pay in accordance with Davis-Bacon requirements. Wage rates on the Project shall not be less than the federal wage scale published by the U.S. Department of Labor available on the day of bid.

The Contract will be awarded in accordance with the provisions of IC 5-16-13 for Public

Works projects awarded after June 30, 2015. Pursuant to IC 5-16-13-7, the provisions of the law are incorporated by reference.

Award will be made to the low, responsive, responsible bidder and must be approved by the State Revolving Fund Loan as administered by the Indiana Finance Authority. In accordance with IC 22-5, Contractors entering into a contract with the Owner, and Contractors of any tier as defined in IC 5-16-13-4, will be required to enroll in and verify the work eligibility status of all newly hired employees through the E-Verify program, and comply with the reporting requirements of IC 5-16-13-11.

In accordance with IC 5-16-13-11, Contractor shall submit an Employee Drug Testing Plan with their Bid and contractors of any tier as defined in IC 5-16-13-4 must comply with the drug testing requirements set forth in IC 4-13-18.

The Owner reserves the right to waive any informalities or minor defects in bids or bidding procedure, or reject any and all bids, or to accept the bid from the lowest most responsible and responsive bidder as exclusively determined by the Owner. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. The award of the Contract is subject to all approvals required by local and federal agencies. Upon securing all approvals, the successful bidder shall receive a construction “Notice to Proceed”. Said Contractor shall begin construction as stipulated in the “Notice to Proceed” and shall complete the project pursuant to the Contract Documents. No bidder may withdraw his proposal within a period of 90 days following the date set for receiving bids. The Owner reserves the right to retain the three lowest bid proposals for a period of not more than 150 days and said proposals shall remain in full force and effect during said time.

The Contractor to whom the Work is awarded will be required to furnish an acceptable Performance and Payment Bond each in the amount of 100 percent of the contract price and must be in full force and effect throughout the term of the Construction Contract plus a period of 12 months from the date of substantial completion.

Submission of a signed Bid by the Bidder constitutes acknowledgment of and acceptance of all the documents and terms and conditions of the Contractual-Legal Requirements and Technical Sections of the Specifications in the Project Manual. General Contractors who submit bids for this Project must purchase one full set of Drawings and Specifications and be registered on the plan holder list.

ORDINANCE NO. 2023-OR-

ORDINANCE ESTABLISHING CERTAIN ROADWAY AS AN “URBAN DISTRICT” FOR PURPOSES OF ESTABLISHING MAXIMUM SPEED LIMITS

WHEREAS, pursuant to I.C. 5-22-2-13, the Scott County is a governmental body, and under I.C. 36-2-2-2, the Board of Commissioners is the County Executive for Scott County;

WHEREAS, in pertinent part, I.C. 9-21-5-2 states, “A person may not drive a vehicle on a highway at a speed in excess of the following maximum limits: (a) Thirty (30) miles per hour in an urban district”;

WHEREAS, I.C. 9-13-2-193 provides the following definition for urban district: “‘Urban district’ means the territory contiguous to and including any street that is built up with structures devoted to business, industry, or dwelling houses situated at intervals of less than two hundred (200) feet for a distance of at least one-fourth (1⁄4) mile” and the definition is applicable throughout the entire Title;

WHEREAS, the Board of Commissioners of Scott County, having taken notice of the state law, has requested the Director of Scott County Highway Department to review certain roadways within the county roadway system to determine whether existing structures along certain roadways meet the statutory definition of “urban district”;

WHEREAS, in addition, the Board of Commissioners has reviewed the GIS mapping system to determine the whether the existing structures along certain roadways meet the statutory definition of “urban district”;

WHEREAS, having taken notice of the statutory definitions and laws and having reviewed the roadway South Double or Nothing Road, from the beginning point of State Road 356 to the ending point of Radio Tower Road, the Board of Commissioners of Scott County has determined that the roadway is an “urban district” as defined by Indiana Code.

NOW, THEREFORE, BE IT ORDAINED BY BOARD OF COMMISSIONERS OF SCOTT COUNTY, INDIANA:

The Board of Commissioners of Scott County has determined that the roadway – that being the roadway South Double or Nothing Road, from the beginning point of State Road 356 to the ending point of Radio Tower Road – is an “urban district” as defined by Indiana Code.

Pursuant to I.C. 9-21-5-2, the speed limit on the above-described roadway is thirty (30) miles per hour and violations are punishable as provided by Indiana Code.

This Ordinance is effective upon the passage, signing, and recording by the presiding officer of the respective executive of the County and upon posting of the speed limits signage along the described roadway.

PERMITTING FOR WORK PERFORMED IN THE COUNTY’S RIGHT-OF-WAY

WHEREAS, pursuant to I.C. 5-22-2-13, the Scott County is a governmental body, and under I.C. 36-2-2-2, the Board of Commissioners is the County Executive for Scott County;

WHEREAS, pursuant to I.C. 8-17-1-1, the County Executive may construct, reconstruct, improve, and maintain all public bridges, highways, and culverts in the County, including all drainage, utilities, and rights-of-way necessary for the County Highway System;

WHEREAS, pursuant to I.C. 8-17-1-39, no material may be used in the construction of a county highway, bridge, or culvert unless the material is equal to the material required and meets all tests and standards required by the department for the building of highways, bridges, or culverts by the Indiana Department of Transportation;

WHEREAS, the Scott County Board of Commissioners has authorized the Scott County Highway Department to oversee the construction, maintenance, and repair of all county roads, rights-of-way, and easements that are a part of the County Highway System;

WHEREAS, in order to meet its obligations to construct, maintain, and repair, the County Highway Department is hereby authorized to require private landowners to secure permits approved by the Director of the Highway Department prior to initiating work on culverts or backfills that runs through the County’s rights-of-way;

WHEREAS, the Director of the Highway Department shall create a permit application listing the requirements, including appropriate materials that meet standards established by the Indiana Department of Transportation, to be used on the proposed work, and specifying the requirement to put the county road or right-of-way back in the same condition it was prior to the work.

NOW, THEREFORE, BE IT RESOLVED BY BOARD OF COMMISSIONERS OF SCOTT COUNTY, INDIANA:

1. Definitions: The following terms shall have meanings set forth below for the purposes of this ordinance.

I. Backfill – This work shall consist of backfilling excavated or displaced peat deposits; filling up to designate elevations of spaces excavated for structures and not occupied by permanent work; constructing bridge approach embankments; and filling over structures and over arches between spandrel walls, all with special material.

2. Culverts – A drain or waterway crossing under a roadway.

II. Purpose of Ordinance:

1. The purpose of this ordinance is to establish the policy for safely, reasonably, and cost effectively managing the right of way of the County Highway system. The County’s goal in managing the right of way is to preserve the integrity, safe operation, and function of the County Highway system.

2. The manner of work performed on or affecting the County’s rights of way can affect the appearance, operation, construction, and maintenance of the highway and the safety of the traveling public. Therefore, it is necessary that any work, use, or occupancy be authorized and reasonably regulated and managed.

III. Scope of the Ordinance:

1. The County, through the County Highway Department and its Director, shall use this policy to responsibly, reasonably, and cost effectively manage and/or regulate the location, design, installation, maintenance, repair, removal, and relocation of certain work proposed to performed with the County’s rights of way.

2. This Ordinance is limited to matters which are the responsibility of Scott County for preserving the safe operation and integrity of the County Highway System.

3. Laws or orders of public authority, industry, or governmental codes that prescribe a higher degree of protection or standards than those described herein shall prevail over this policy.

4. In order to manage its obligations, the County is adopting a uniform policy for the issuance of permits for backfill and culvert installations within the County’s rights of way so that the work is performed to the standards required and does not endanger the traveling public.

IV. Procedure for Submitting Permit Applications:

1. The Director of the Scott County Highway Department shall provide a uniform permit application in compliance with this Ordinance.

2. A private landowner that desires to occupy, even temporarily, or to install backfill or culverts within the County’s rights of way shall submit a permit request to the Scott County Highway Department prior to performing any work.

3. The Director of the Scott County Highway Department will review the permit request to ensure compliance with this Ordinance and any other state or federal laws, policies, or regulations that may be applicable.

4. The Director of the Scott County Highway Department may deny a permit request that does not conform to this ordinance or any other applicable requirements.

5. If a permit is denied, a written explanation shall be provided. If a permit is approved, a permit will be issued.

6. The Director of the Scott County Highway Department may revoke a permit. A cause to revoke a permit is the failure to comply with terms of the permits and its provisions.

V. Backfill and Compaction Specifications:

1. In order ensure uniformity of work and standards for materials, the following specifications shall apply for the purposes of this Ordinance:

a. The approved backfill materials shall follow the Indiana Department of Transportation

requirements, including but limited to the following requirements:

i. B Borrow as defined by section 211.02 of the Indiana Department of Transportation standards;

ii.

Flowable Backfill as defined by section 213 of the Indiana Department of Transportation standards;

iii. Geotextile as defined by section 918.02.02 of the Indiana Department of Transportation standards;

iv. Structure Backfill as defined by section 904 of the Indiana Department of Transportation standards.

b. Structure Backfill Types shall be as follows and the landowner requesting a permit shall choose from the following list:

i. Type 1

1. Structure Backfill in accordance with section 904.05 of the Indiana Department of Transportation standards.

2. Non-removable or removable flowable backfill in accordance with section 213 of the Indiana Department of Transportation standards.

ii. Type 2

1. Crushed stone aggregate or ACBF structure backfill in accordance with section 904.05, except No. 30, No. 4, and 2 in. nominal size aggregate shall not be used, of the Indiana Department of Transportation standards.

2. Non-removable or removable flowable backfill in accordance with section 213 of the Indiana Department of Transportation standards.

iii. Type 3

1. Structure backfill in accordance with section 904.5, except only nominal size aggregates 1in., 1/2 in., No. 4 or No. 30, and course aggregate No. 5, No. 8, No. 9, No. 11, or No. 12 shall be stone. ACBF meeting the size requirements for course aggregate No. 5 or No. 8 may also be used.

c. Compaction shall be as follows:

i. B Borrow and structure backfill types 1, 2, and 3 shall be compacted with mechanical tamps or vibrators in accordance with the applicable provisions of 203.23 of the Indiana Department of Transportation standards except as otherwise set forth herein.

ii. Aggregate for end bent backfill and coarse aggregate used for structure backfill shall be deposited in layers not to exceed 12 in. loose measurement. Each layer shall be mechanically compacted with a compactor having a plate width of 17 in. or larger that delivers 3,000 to 9,000 lb. per blow. Each lift shall be compacted with two passes of the compactor.

2. Each individual or entity submitting a permit request is responsible for the design of their proposed work or installation including the preparation of a work plan, narratives, drawings, cost estimates, and specifications. The drawings shall be of sufficient detail and scale to show the proposed location of the work or installation to be performed.

VI. Irrigation and Drainage Pipes:

1. Irrigation and drainage pipes crossing the County’s rights of way may be permitted.

Irrigation and drainage pipes installed across any County right of way must be designed, constructed, and maintained in accordance with the Indiana Department of Transportation standards for culverts and bridges.

2. Individuals or entities requesting to install an irrigation or drainage pipe across any County right of way shall submit a permit application to the Director of the Scott County Highway Department in accordance with subsection IV of this Ordinance prior to performing any work or installing the irrigation or drainage pipe.

VII. Safety and Convenience:

1. Traffic control for work or installations within the County’s rights of way will conform to the Indiana Manual of Uniform Traffic control devices or the Indiana Department of Transportation Work Zone Safety Handbook. All work will be planned with due consideration to the safety of the public and maintaining traffic mobility.

2. A traffic control plan shall be submitted with each permit application.

3. The individual or entity requesting a permit shall assure that their work site is secure against hazards to the public at all times until their work is completed and shall comply with all legal requirements for ensuring safety of workers.

VIII. Pavement Cuts:

1. Open cutting of pavement on county highways is highly disfavored because its adversely affects the integrity of the pavement and may disrupt the flow of traffic.

2. An individual or entity that desires to install or perform work by open cut shall obtain a separate “cut road permit” from the Director of the Scott County Highway Department prior to starting their work.

3. The permit request shall explain the reasons why the individual or entity desires to install their facilities by open cut.

4. At the conclusion of the work, all cuts in the pavement shall be repaired with like materials, to a similar or greater depth and to a condition equal to or better than the condition of the pavement prior to the work and in accordance with standards of the Indiana Department of Transportation.

5. The Director of the Scott County Highway Department shall inspect all pavement cuts in the roadway to determine the extent of pavement repairs. The individual or entity requesting the pavement cut shall submit their pavement design for the repair of the pavement when the permit is requested. The design for pavement repairs will be approved prior to a permit being issued.

6. Upon completion of the repair work, the individual or entity that obtained the “road cut permit” shall provide the Director of the Scott County Highway Department with at least three photographs from different viewpoints of the repaired roadway.

7. The individual or entity that fails to meet the requirements of this subsection shall be responsible for all costs of repairs should the final work not meet the standards outlined in their submitted plan.

IX. Compliance and Penalties:

1. The Director of the Scott County Highway Department shall enforce all provisions of this Ordinance. Upon determining that a violation has occurred, the Director shall issue a cease and desist order to the individual or entity in violation of this Ordinance. The

individual or entity shall timely resolve the violation by complying with this Ordinance within fifteen (15) days.

2. If a violation continues, the Director of the Scott Highway Department may issue a Citation to any person or entity which may be found to be in violation of this ordinance. The person or entity receiving a Citation shall be required to be appear, at a time designated, in any circuit or superior court in Scott County, Indiana for a hearing upon such Citation. The Court shall conduct a hearing upon the alleged violation of this Ordinance. The Attorney for the Board of Commissioners, or any attorney appointed by it, is authorized to civilly prosecute said Citation in the name of the Scott County Highway Department in such hearing. If the Court finds, at the conclusion of all evidence, by a preponderance of the evidence, that this Ordinance has been violated, the Court shall impose the sanctions and penalties described below.

3. Penalties – Any person or entity convicted of a violation of this Ordinance shall be punished by a fine of not less than Twenty-Five and 00/100 Dollars ($25.00) and not more than Two Thousand Five Hundred and 00/100 Dollars ($2,500.00) for each violation. See I.C. 36-1-3-8(10). Each day, or part of a day, that each violation occurs shall constitute a distinct and separate offense punishable by a fine. Each fine hereunder shall be in addition to, and not in substitution of, any other penalties which may be set forth under any chapter, section, or provision of this Ordinance and nothing contained herein shall be construed as preventing the enforcement of the ordinance by injunction or any other equitable or legal relief as provided by I.C. 36-1-6, et I.C. 16-1-4-13 or any other applicable law.

X. Severability:

1. If any Court of competent jurisdiction rules any provision of this Ordinance invalid, that ruling shall not affect any provision not specifically included in the judgment.

2. If any Court of Competent jurisdiction rules invalid the application of any provision of this Ordinance to a particular property, installation, or work, that ruling shall not affect the application of the Ordinance provisions to any property, other installation, or other work not specifically included in the judgment.

XI. Adoption:

1This Ordinance is effective upon the passage, signing, and recording by the presiding officer of the respective executive bodies of the County.

This Project involves the installation of the following:

The bids shall be unit price for all work shown on the plans and called for in the specifications and as detailed on the bid forms and in the information for bidders.

The bidder must file with their sealed bid proposal, a certified check or a bid bond in the amount equal to ten (10) percent of the total bid, payable to the Scott County School Board District 1. The above check or bond is to insure the execution of the contract on which such bid is made.

The qualified Contractor to whom the work is awarded shall furnish, within ten (10) days after the date of said contract award and before commencing work, a performance and payment bond in an amount equal to the bid price of the contract awarded to said contractor, and certificates of all insurance required by the Specifications.

The Bid security of the three lowest Bidders will be retained until the Contract has been awarded and executed, but no longer than sixty (60) days from the date of opening Bids. The Owner reserves the right to reject any proposal, or all proposals, or to accept any proposal or proposals, or to make such combination of proposals as may seem desirable, and to waive any and all informalities in bidding. Any proposal may be withdrawn prior to the above scheduled time for the opening of proposals or authorized postponement thereof. Any proposal received after the time and date specified shall not be considered. No proposal may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days.

A conditional or qualified Bid will not be accepted.

Award will be made to the lowest, responsive, responsible bidder.

All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Bids shall be properly and completely executed on bid forms included in the Specifications. The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.
