ORDINANCE NO. 2023-21
AN ORDINANACE AMENDING THE ZONING ORDINANCE FOR THE CITY OF SCOTTSBURG, INDIANA
WHEREAS, the Common Council of the City of Scottsburg, Indiana (the “Council”) has adopted the Zoning Ordinance as Ordinance No. 2004-13; and
WHEREAS, I.C. 36-7-4, et seq., empowers the City of Scottsburg Plan Commission (“Plan Commission”) to hold public hearings and make recommendations to the Council concerning ordinances for the zoning or districting of all lands within the City of Scottsburg; and,
WHEREAS, the Plan Commission has conducted a public hearing in accordance with I.C. 36-7-4, et seq., with respect to a proposal to amend the Scottsburg Zoning Ordinance, and
has certified such amendment to the Council with a favorable recommendation:
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SCOTTSBURG that the City of Scottsburg, Indiana Code of Ordinances is hereby amended and recodified as follows:
SECTION 1. That the Scottsburg Zoning Ordinance, Ordinance No. 2004-13, as amended, be further amended in the following manner: by adding Article 5 (W), adding to Article 11 (M), and by inserting the double-underlined text as set forth in the attached Exhibit “A” attached hereto and incorporated herein.
SECTION 2: This Ordinance shall have no effect upon any other provisions of the Zoning Ordinance except as herein provided, and all other sections of said Ordinance not inconsistent herewith shall remain the same.
SECTION 3: If any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the other remaining parts.
SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as provided in I.C. 36-7-4.

EXHIBIT “A”
1. Article 3 (G)(2)(b) shall be amended to read:
A-3-G Highway Business, B-3
(b) Permitted uses. The following uses are permitted in the B-3 District.
(1) All uses permitted in the B-1 and B-2 Districts.
(2) Big box retail, as defined in Article A-11.
(3) Outdoor commercial recreation.
(4) Travel-oriented businesses as defined in Article A-11.
(5) Extended Stay Hotel/Motel as defined in Article A-11.
2. The following definition shall be added to Article 11 (M):
Extended Stay Hotel/Motel. Any building containing guestrooms intended or designed to be used, or which are used, rented, hired out to be occupied, or which are occupied for sleeping and living purposes for guests in excess of thirty (30) continuous days.
3. The following definitions in Article 11 (M) shall be amended to read:
Hotel. A building in which temporary lodging or board and lodging are provided and offered to the public for compensation and in which ingress and egress to and from all rooms is made through an inside lobby or office supervised by a person in charge at all hours. As such, it is open to the public. Compensation is usually assessed on a day-to-day basis. Occupancy stays are not intended to be for more than thirty (30) continuous days.
Motel. An establishment consisting of a group of attached or detached living or sleeping accommodations with bathroom and closet space, located on a single zoning lot, and designed for use by transient automobile travelers. A motel furnishes customary services such as maid service and laundering of linen, telephone, secretarial, or desk service, and the use and upkeep of furniture. Occupancy stays are not intended to be for more than thirty (30) continuous days.
4. The following section shall be added to Article 5 as Section W and shall read:
A-5-W Extended Stay Hotel/Motel
(a) General Requirements. All Extended Stay Hotel/Motels shall comply with the following requirements:
(1) No operator, owner, keeper, or proprietor of any Extended Stay Hotel/Motel shall rent or provide a room for any number of persons greater than the sleeping accommodations provided within the particular rental unit. E.g., one (1) person for each bed with a single sized mattress, and/or two (2) persons for each bed with a full-, queen-, or king-sized mattress.
(2) No operator, owner, keeper, or proprietor, patron, visitor, or guest of any Extended Stay Hotel/Motel shall permit or allow to congregate within any room or single rental unit a number of persons which is greater than two (2) times the number of persons for whom sleeping accommodations are provided within the single room or rental unit except when temporarily designated as a hospitality suite by the Extended Stay Hotel/Motel.
(3) Extended Stay Hotel/Motel facilities are not to serve as a residence.
(4) No customer of an Extended Stay Hotel/Motel shall stay in the same unit for more than thirty (30) consecutive nights.
(5) After a cumulative stay of sixty (60) consecutive nights by a customer, said customer, and any visitors or guests, shall vacate the premises of said Extended Stay Hotel/Motel, and no operator, owner, keeper, or proprietor of any Extended Stay Hotel/Motel shall rent or provide a room to said customer, visitor, or guest for at least fifteen (15) consecutive nights following the last day of the prior occupancy..
(6) Every operator, owner, keeper, or proprietor of any Extended Stay Hotel/Motel shall keep and maintain in each rental unit, a telephone equipped to place a direct call to 911.
(7) Each guest room of an Extended Stay Hotel/Motel shall be equipped with a sprinkler
system and hard-wired smoke detector approved by the fire marshal.
(8) Each unit of an Extended Stay Hotel/Motel must be three hundred sixty (360) square feet or greater in size to be considered an extended stay unit.
(9) Each unit of an Extended Stay Hotel/Motel shall contain kitchenette facilities, including at a minimum, the following:
a. An operable refrigerator of eighteen (18) cubic feet capacity.
b. A microwave.
c. A thirty-two inch (32”) wide sink with operable hot and cold-water faucet(s) located outside of the bathroom facility of the unit.
d. Four and one-half (4 1/2) feet of base cabinets.
e. A dining table of sufficient size to seat two adult persons comfortably.
(b) Compliance.
(1) The common areas and unoccupied rooms of an Extended Stay Hotel/Motel facility are subject to inspection by the City of Scottsburg.
(2) No Hotel, Motel, or Extended Stay Hotel/Motel facility shall be initially constructed, operated, or converted to be and operated as an Extended Stay Hotel/Motel unless in full compliance with each of the provisions in this section.
(3) An Extended Stay Hotel/Motel facility that fails to meet the requirements of this section is prohibited from offering any extended stay rentals exceeding thirty (30) days.
(4) Any Extended Stay Hotel/Motel facility operated, conducted, or maintained contrary to the provisions of this section may be declared to be unlawful and an unsafe building. The City may, in addition, or in lieu of all other remedies, commence actions or proceedings for abatement, removal or enjoinment thereof, in the manner provided by state law and this Code.

Pursuant to the laws of the Indiana General Assembly, notice is hereby given that the following described property is listed for sale for delinquent taxes and/or special assessments. The county auditor and county treasurer will apply on or after 09/19/2023 for a court judgment against the tracts or real property for an amount that is not less than the amount set out below and for an order to sell the tracts or real property at public auction to the highest bidder, subject to the right of redemption. Any defense to the application for judgment must be filed with the Scott County Circuit Court and served on the county auditor and treasurer before 09/19/2023. The court will set a date for a hearing at least seven (7) days before the advertised date of sale and the court will determine any defenses to the application for judgment at the hearing. The county auditor and the county treasurer are entitled to receive all pleadings, motions, petitions, and other filings related to the defense to the application for judgment.
Such sale will be held on 10/06/2023 at the Courthouse – Comm Room and that sale will continue until all tracts and real property have been offered for sale. At the discretion of local officials, the tax sale may switch to an online format. If those measures are taking place, the public auction will be conducted as an electronic sale under IC 6-1.1-24-2 (b) 10 at www.zeusauction.com commencing on the same date/time listed above. Property will not be sold for an amount which is less than the sum of:
(A) the delinquent taxes and special assessments on each tract or item of real property; and
(B) the taxes and special assessments on the real property that are due and payable in the year of the sale, whether or not they are delinquent; and
(C) all penalties due on the delinquencies, and
(D) an amount prescribed by the county auditor that equals the sum of:
(1) twenty-five dollars ($25) for postage and publication costs; and
(2) any other costs incurred by the county that are directly attributable to the tax sale; and
(E) any unpaid costs due under IC 6-1.1-24-2(c) from a prior tax sale.
No property listed below shall be sold if, at any time before the sale, the Total Amount for Judgment is paid in full. If the real property is sold in the tax sale, the amount required to redeem such property will be 110% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed not more than six (6) months after the date of sale, or 115% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed more than six (6) months after the date of sale, plus the amount by which the purchase price exceeds the minimum bid on the real property plus five percent (5%) per annum interest on the amount by which the purchase price exceeds the minimum bid on the property. All taxes and special assessments upon the property paid by the purchaser subsequent to the sale, plus five percent (5%) per annum interest on those taxes and special assessments, will also be required to be paid to redeem such property.
In addition, IC 6-1.1-25-2 (e) states the total amount required for redemption may include the following costs incurred and paid by the purchaser or the purchaser’s assignee or the county before redemption: (1) The attorney’s fees and cost of giving notice under IC 6-1.1-25-4.5; (2) The costs of title search or examining and update the abstract of title for the tract or item of real property. The period of redemption shall expire on Monday, October 07, 2024 for certificates sold in the tax sale. For certificates struck to the county, the period of redemption may expire Monday, February 05, 2024.
If the tract or item of real property is sold for an amount more than the minimum bid and the property is not redeemed, the owner of record of the property who is divested of ownership at the time the tax deed is issued may have a right to the tax sale surplus.
The Auditor and Treasurer specifically reserve the right to withhold from the sale any parcel which has been listed in error, or which otherwise becomes ineligible for sale either prior to 10/06/2023 or during the duration of the sale.
This notice of real property tax sale, and the tax sale itself are undertaken and will be conducted pursuant to the requirements of the laws of the State of Indiana which regulate the sale of land for delinquent taxes, pursuant to I.C. 6-1.1-24-1 et seq.
The County does not warrant the accuracy of the street address or common description of the property, and a misstatement in the key number or street address does not invalidate an otherwise valid sale.

Pursuant to the laws of the Indiana General Assembly, notice is hereby given that the following described property is listed for sale for delinquent taxes and/or special assessments. The county auditor and county treasurer will apply on or after 10/03/2023 for a court judgment against the tracts or real property for an amount that is not less than the amount set out below and for an order to sell the tracts or real property at public auction to the highest bidder, subject to the right of redemption. Any defense to the application for judgment must be filed with the Jackson County Circuit Court and served on the county auditor and treasurer before 10/03/2023. The court will set a date for a hearing at least seven (7) days before the advertised date of sale and the court will determine any defenses to the application for judgment at the hearing. The county auditor and the county treasurer are entitled to receive all pleadings, motions, petitions, and other filings related to the defense to the application for judgment.
Such sale will be held on 10/20/2023 at the Courthouse – 2nd Floor Courtroom and that sale will continue until all tracts and real property have been offered for sale. At the discretion of local officials, the tax sale may switch to an online format. If those measures
are taking place, the public auction will be conducted as an electronic sale under IC 6-1.1-24-2 (b) 10 at www.zeusauction.com commencing on the same date/time listed above. All location updates will be posted at www.sriservices.com prior to the tax sale.
Property will not be sold for an amount which is less than the sum of:
(A) the delinquent taxes and special assessments on each tract or item of real property; and
(B) the taxes and special assessments on the real property that are due and payable in the year of the sale, whether or not they are delinquent; and
(C) all penalties due on the delinquencies, and
(D) an amount prescribed by the county auditor that equals the sum of:
(1) twenty-five dollars ($25) for postage and publication costs; and
(2) any other costs incurred by the county that are directly attributable to the tax sale; and
(E) any unpaid costs due under IC 6-1.1-24-2(c) from a prior tax sale.
No property listed below shall be sold if, at any time before the sale, the Total Amount for Judgment is paid in full. If the real property is sold in the tax sale, the amount required to redeem such property will be 110% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed not more than six (6) months after the date of sale, or 115% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed more than six (6) months after the date of sale, plus the amount by which the purchase price exceeds the minimum bid on the real property plus five percent (5%) per annum interest on the amount by which the purchase price exceeds the minimum bid on the property. All taxes and special assessments upon the property paid by the purchaser subsequent to the sale, plus five percent (5%) per annum interest on those taxes and special assessments, will also be required to be paid to redeem such property.
In addition, IC 6-1.1-25-2 (e) states the total amount required for redemption may include the following costs incurred and paid by the purchaser or the purchaser’s assignee or the county before redemption: (1) The attorney’s fees and cost of giving notice under IC 6-1.1-25-4.5; (2) The costs of title search or examining and update the abstract of title for the tract or item of real property. The period of redemption shall expire on Monday, October 21, 2024 for certificates sold in the tax sale. For certificates struck to the county, the period of redemption may expire Monday, February 19, 2024.
If the tract or item of real property is sold for an amount more than the minimum bid and the property is not redeemed, the owner of record of the property who is divested of ownership at the time the tax deed is issued may have a right to the tax sale surplus.
The Auditor and Treasurer specifically reserve the right to withhold from the sale any parcel which has been listed in error, or which otherwise becomes ineligible for sale either prior to 10/20/2023 or during the duration of the sale.
This notice of real property tax sale, and the tax sale itself are undertaken and will be conducted pursuant to the requirements of the laws of the State of Indiana which regulate the sale of land for delinquent taxes, pursuant to I.C. 6-1.1-24-1 et seq.

I hereby certify that the foregoing is a true list of lots and land returned delinquent for the nonpayment of taxes and special assessments for the time periods set forth, also subsequent delinquent taxes, current taxes and costs due thereon and the same are chargeable with the amount of tax, etc., with which they are charged on said list.
