This program is funded by Title I of the Housing and Community Development Act of 1974, as amended. These funds are to be used for a community development project which includes a Housing Owner-Occupied Rehab Program with the following activities: Rehabilitation of scattered owner-occupied homes within Austin. The total amount of CDBG funds to be requested is $250,000.00. The amount of CDBG funds proposed to be used for activities that will benefit to low- and moderate-income persons is approximately $240,000. The Applicant also proposed to expend an estimated $25,000 in non-CDBG funds on the project. The non-CDBG funds will be derived from the City of Austin’s general fund.

NOTICE OF ADOPTION OF AN ORDINANCE REGULATING CULVERT USAGE AND MAINTENANCE FOR THE TOWN OF CROTHERSVILLE, INDIANA

Taxpayers, property owners, and other interested parties in the Town of Crothersville, Indiana (“Town”) are hereby notified that the Town Council adopted an ordinance regulating culvert usage and maintenance in the Town of Crothersville.  The effective date of the ordinance is July 6, 2021.

ORDINANCE NO. 2021 – 6

AN ORDINANCE OF THE TOWN OF CROTHERSVILLE REGULATING CULVERT USAGE AND MAINTENANCE

WHEREAS, the Town Council for the Town of Crothersville, Indiana has seen a need to enact an ordinance regulating placement, replacement, maintenance, and use of culverts within the Town; and

WHEREAS, the intent of this ordinance is to govern all activities within the right-of-way of all streets, roads, and alleys as related to the placement, replacement, maintenance, and use of culverts or piping in roadside ditches; and

NOW, THEREFORE, BE IT ORDAINEDby the Town Council of the Town of Crothersville, Indiana, that an ordinance regulating the placement, replacement, maintenance, and use of culverts be enacted, which reads as follows.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CROTHERSVILLE, AS FOLLOWS:

Section 1:  This ordinance shall govern all activities within the right-of-ways of all streets, roads, and alleys as related to the placement of any new culvert or piping in roadside ditches.

Section 2:  Any improvements, modifications, or other work that may disturb any portion of the Town’s right-of-way requires a permit, which may be issued by the Town of Crothersville, at its discretion.

Section 3:  The permit application must be submitted to the Town at least seventy-two (72) hours before the improvements, modifications, or other work are set to begin.  The application must be approved and the permit issued prior to the work beginning.

Section 4:  Any deviation from the standard use of the right-of-way shallrequire approval of the Town Council and could take up to sixty (60) days.

Section 5:  Placement of New Culvert.  This section shall govern all activities within the right-of-ways of all streets, roads, and alleys as related to the placement of any new culvert or piping in roadside ditches.

(a) All work must maintain the flow of water and not impede or cause the water to back up in any way.

(b) When improvements are made within the right-of-way, said improvements must be done according to the current standards.

(c) The Town shall determine what size and type of driveway culverts shall be allowed.  The party doing work shall contact the Town to find out what size and type is required.

(d) All backfilling of culverts must use granular fill.  Dirt or other matter shall not be permitted for use as backfill.

(e) All areas to be improved must be inspected by the Town’s Utility Director prior to work taking place.

(f) The Town will not install any materials related to culvert work in the right-of-way.  Purchase of culverts may be made through the Town.

(g) Any improvements or modifications to roadside ditches and placement of new culverts in the Town shall require a permit to be obtained from the Town.  The permit applications may be obtained at the Crothersville Town Hall and must be submitted, reviewed, approved, and paid for prior to any work taking place.

(h) All permit applications shall be submitted with a $100.00 fee to cover the Town’s cost to review the information on the application and inspect the work.

(i) All work must be completed within ninety (90) days of obtaining the permit unless the Town approves an exception. No exception shall exceed one hundred and eighty (180) days.  Any work exceeding one hundred and eighty (180) days shall require a new application with application fee.

Section 6: Replacement of Existing Culvert.

(a) Sections 1-5 are incorporated into this Section 6.

(b) Replacement of existing culverts may be completed by the property owner, who must follow the same requirements as an installer of a new culvert.

(c) The property owner may request replacement of an existing culvert by the Town, with the purchase of the culvert, size, and type of culvert to be determined by the Town. 

(d) The property owner must complete and submit an application at the Crothersville Town Hall.  The application will be reviewed and the culvert will be inspected by the Utility Director prior to approval, which will be at the Town’s discretion.

(e) The Town will contact the applicant to discuss the cost to the property owner and scheduling of the replacement.

(f) Payment for the purchase of the culvert must be made to the Town prior to the work beginning.

(g) If the application is approved, the Town will install only one (1) culvert per property owner.

Section 7:  Failure to abide by this ordinance or adhere to the rules pertaining to the Town’s right-of-ways will result in a fine of up to $2,500.00.  In addition, the Town may inspect the improvements, modifications, or other work performed and may require any improvements, modifications, or other work performed in the right-of-way without proper approval to be undone and the right-of-way returned to its previous, undisturbed condition, at the property owner’s expense.

Section 8:  If any section, paragraph, clause, or phrase of this ordinance should be declared unconstitutional or invalid, the remainder of said ordinance shall continue in full force and effect.

Section 9:  All prior ordinances or parts thereof inconsistent with any provision of this ordinance are hereby repealed.

Section 10:  This Ordinance shall be in full force and effect from and after its passage, and approval by the Town Council, all as by law provided.

ADVERTISEMENT FOR BIDS

Notice is hereby given, that the City of Austin, Indiana, hereinafter referred to as the Owner, will receive sealed bids for the construction of the following project:

CITY OF AUSTIN 2021 ROADWAY RESURFACING PROJECT

The specifications and accompanying Proposed Roads 2021 and Enterprise Avenue drawings describe the work to be done and the materials to be furnished for the construction of the improvements.  The project generally consists of the following:

Asphalt overlay of approximately 1.32 miles of residential roadways along with converting 250ft of gravel road to asphalt located within the Austin City limits.

Sealed bids are invited and may be delivered or forwarded by registered mail, addressed to the City of Austin, City Hall, 80 W. Main St., Austin, IN 47102 until 3:00 pm  (local time) on  September 1, 2021. Bids received after such hour will be returned unopened.  Each Bid shall be enclosed in a sealed envelope bearing the title “City of Austin 2021 Roadway Repaving Project” and the name and address of the Bidder.

The bids will be publicly opened and read aloud at 3:00 pm on September 1, 2021 at the Austin City Hall.

Approved performance and payment bonds guaranteeing faithful and proper performance of the work and materials, to be executed by an acceptable surety company, will be required of the Contractor at the time of contract execution. The bonds will be in the amount of 100% of the Contract Price and must be in full force and effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion.

The Owner reserves the right to reject any bid, or all bids, or to accept any bid or bids, or to make such combination of bids as may seem desirable, and to waive any and all informalities in bidding.  Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof.  Any bid received after the time and date specified shall not be considered.  No bid may be withdrawn after the scheduled closing time for receipt of bids for at least ninety (90) days.

A conditional or qualified Bid will not be accepted.

Award will be made to the lowest, responsive, responsible bidder.

All applicable laws, ordinances and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout.

Bids shall include all information requested by Indiana Form 96.  Under Section III of Form 96, the Bidder shall submit a financial statement (i.e. Indiana Form 96A or equivalent).  The Owner may make such investigations as deemed necessary to determine the ability of the Bidder to perform the work and the Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request.  The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.
