NOTICE OF PRELIMINARY DETERMINATION OF THE BOARD OF COMMISSIONERS OF JACKSON COUNTY, INDIANA, TO ENTER INTO A PROPOSED LEASE OF A FACILITY OPERATED BY JACKSON COUNTY, INDIANA IN CONNECTION WITH THE PROPOSED JACKSON COUNTY WORK RELEASE CENTER PROJECT
Owners of real property, and registered voters residing, in Jackson County, Indiana (the “County”), hereby are given notice that the Board of Commissioners of the County (the “Board”) preliminarily has determined, at its meeting held August 6, 2019, that (I) a need exists for the proposed construction and equipping of a county work release center (the “Facility”) currently anticipated to be located at 324 Dupont Drive in Seymour, Indiana, and upon completion is anticipated to include, but not be limited to, two men’s sleeping dorms accommodating approximately fifty beds each, one women’s sleeping dorm accommodating approximately fifty beds, ancillary spaces to each sleeping dorm including, but not limited to, dayroom space, vending areas, laundry, toilet/shower facilities and one or more janitor’s closet, common spaces including, but not limited to, a central control room, a commissary room, approximately four classrooms, approximately two medical rooms, a booking room, a property locker room, a secure vestibule; office spaces for approximately twenty staff members, a conference room, a copier room, a file room, a server room, a break room and associated restrooms for staff and visitors, janitors closet, a mechanical room, a garage, outdoor site improvements including, but not limited to, parking lots, driveways, sidewalks, utilities, signage and landscaping and all projects related to any of the foregoing, all of which will be operated by the County (collectively, the “Jackson County Work Release Center Project”); and (II) to the extent permitted by law to take all of the necessary steps to finance all or a portion of the costs of the Jackson County Work Release Center Project by entering into a proposed lease between a nonprofit local building corporation controlled by the County, as lessor (the “Building Corporation”), and the County, as lessee, relating to all or any portion of the real estate upon which the Facility will be constructed and upon its completion, all or a portion of the Facility which will be operated by the County (collectively, the “Lease”). The Building Corporation, as lessor, will issue one or more series of bonds secured by and payable from the lease payments under the Lease (the “Bonds”). The total maximum original aggregate principal amount of the Bonds will not exceed $5,900,000.
The maximum term for the Bonds will not exceed twenty (20) years, and the Lease with respect to each facility will have a maximum term not to exceed twenty (20) years, beginning on the date all or a portion of the real estate upon which the Facility will be constructed is acquired by the Building Corporation. Based on an estimated maximum average interest rate that will be paid in connection with the Bonds of 5.00% per annum, the total interest cost associated therewith, not excluding any funds of the County or the Building Corporation used to pay capitalized interest, will not exceed $3,950,000 (which amount is net of any funds received by the County or the Building Corporation from the United States of America as a result of any or all of the Bonds being issued under one or more federal tax credit programs). Including interest costs, the maximum annual lease rental to be paid by the County under the Lease is $500,000 (which amount is net of any funds received by the County or the Building Corporation from the United States of America as a result of any or all of the Bonds being issued under one or more federal tax credit programs), and the maximum total lease rental paid by the County over the term of the Lease is $9,300,000 (which amount is net of any funds received by the County or the Building Corporation from the United States of America as a result of any or all of the Bonds being issued under one or more federal tax credit programs), not taking into account any funds of the County or the Building Corporation available for capitalized interest. The County’s certified total debt service fund tax levy for 2018 pay 2019 (which is the most recent certified tax levy) is $871,435, and the County’s debt service fund tax rate for 2018 pay 2019 (which is the most recent certified tax rate) is $0.0452 per $100 of assessed value. The estimated total maximum debt service fund tax levy for the County and the estimated total maximum debt service fund tax rate for the County after the issuance of the Bonds is expected to be $871,435 and $0.0452 per $100 of assessed value, respectively, in 2021 pay 2022 as a result of the payment of the lease rentals under the Lease. In addition, such estimated total maximum debt service fund tax levy and such estimated total maximum debt service fund tax rate which takes into account the anticipated pay-off of other currently outstanding obligations of the County is expected to result in no incremental increase in the total maximum debt service fund tax rate of the County in any year over the first ten years after the issuance of the Bonds. The percent of the County’s current annual debt service/lease payments and projected maximum annual debt service/lease payments after the issuance of the Bonds compared to the net assessed value of taxable property within the County is approximately 0.12%. The percent of the County’s outstanding long term debt, together with the outstanding long term debt of other taxing units that include any of the territory of the County, compared to the net assessed value of taxable property within the County is approximately 2.15%.
Petitions requesting the application of a petition and remonstrance process to the issuance of the Bonds and the lease rental payments under the Lease related to the Jackson County Work Release Center Project may be filed with the Jackson County Voter Registration Office within thirty days after the date of the publication of this notice in the manner provided by Indiana Code § 6-1.1-20-3.1, as amended, and any such petitions must specifically reference that they are being filed in connection with the Jackson County Work Release Center Project set forth in this notice.

Pursuant to the laws of the Indiana General Assembly, notice is hereby given that the following described property is listed for sale for delinquent taxes and/or special assessments. The county auditor and county treasurer will apply on or after 09/16/2019 for a court judgment against the tracts or real property for an amount that is not less than the amount set out below and for an order to sell the tracts or real property at public auction to the highest bidder, subject to the right of redemption. Any defense to the application for judgment must be filed with the Scott County Circuit Court and served on the county auditor and treasurer before 09/16/2019. The court will set a date for a hearing at least seven (7) days before the advertised date of sale and the court will determine any defenses to the application for judgment at the hearing. The county auditor and the county treasurer are entitled to receive all pleadings, motions, petitions, and other filings related to the defense to the application for judgment.
Such sale will be held on 10/03/2019 at the Courthouse – Commissioners’ Room and that sale will continue until all tracts and real property have been offered for sale.
Property will not be sold for an amount which is less than the sum of:
(A) the delinquent taxes and special assessments on each tract or item of real property; and
(B) the taxes and special assessments on the real property that are due and payable in the year of the sale, whether or not they are delinquent; and
(C) all penalties due on the delinquencies, and
(D) an amount prescribed by the county auditor that equals the sum of:
(1) twenty-five dollars ($25) for postage and publication costs; and
(2) any other costs incurred by the county that are directly attributable to the tax sale; and
(E) any unpaid costs due under IC 6-1.1-24-2(c) from a prior tax sale.
No property listed below shall be sold if, at any time before the sale, the Total Amount for Judgment is paid in full. If the real property is sold in the tax sale, the amount required to redeem such property will be 110% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed not more than six (6) months after the date of sale, or 115% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed more than six (6) months after the date of sale, plus the amount by which the purchase price exceeds the minimum bid on the real property plus five percent (5%) per annum interest on the amount by which the purchase price exceeds the minimum bid on the property. All taxes and special assessments upon the property paid by the purchaser subsequent to the sale, plus five percent (5%) per annum interest on those taxes and special assessments, will also be required to be paid to redeem such property.
In addition, IC 6-1.1-25-2 (e) states the total amount required for redemption may include the following costs incurred and paid by the purchaser or the purchaser’s assignee or the county before redemption: (1) The attorney’s fees and cost of giving notice under IC 6-1.1-25-4.5; (2) The costs of title search or examining and update the abstract of title for the tract or item of real property. The period of redemption shall expire on Monday, October 05, 2020 for certificates sold in the tax sale. For certificates struck to the county, the period of redemption may expire Friday, January 31, 2020 .
If the tract or item of real property is sold for an amount more than the minimum bid and the property is not redeemed, the owner of record of the property who is divested of ownership at the time the tax deed is issued may have a right to the tax sale surplus.
The Auditor and Treasurer specifically reserve the right to withhold from the sale any parcel which has been listed in error, or which otherwise becomes ineligible for sale either prior to 10/03/2019 or during the duration of the sale.
This notice of real property tax sale, and the tax sale itself are undertaken and will be conducted pursuant to the requirements of the laws of the State of Indiana which regulate the sale of land for delinquent taxes, pursuant to I.C. 6-1.1-24-1 et seq.
The County does not warrant the accuracy of the street address or common description of the property, and a misstatement in the key number or street address does not invalidate an otherwise valid sale.
