NOTICE OF ADOPTION OF ANNEXATION ORDINANCE
NOTICE is hereby given that Ordinance No. 2018-19 was adopted by the Common Council of the City of Scottsburg on December 17, 2018, which provided for annexation of territory located outside the current municipal boundary of the City of Scottsburg consisting of approximately 43.919 acres south of Meranda Lane, as legally described in Exhibit “A”. The Annexation Ordinance reads as follows:

WHEREAS, the City of Scottsburg (the “City”) is authorized by IC 36-4-3-1 et seq. (the “Act”) to annex territory which is contiguous to the City’s boundary;
WHEREAS, the Common Council of the City has received a petition from Howser and Lucas Properties, LLC, requesting the City to annex into the City certain real estate bounded on the north by Meranda Lane, that is described in Exhibit “A”, which is attached hereto and incorporated herein, by reference (the “Territory”), and the Territory is located outside the current municipal boundary of the City;
WHEREAS, at least one-eighth (1/8) of the aggregate external boundaries of the Territory coincides with the municipal boundaries of the City;
WHEREAS, the Common Council desires to annex the Territory into the City;
WHEREAS, the City has developed and adopted a written fiscal plan and adopted a definite policy for providing services concurrently with the passage of this ordinance.
WHEREAS, the appropriate notices have been mailed and published and public hearings have been opened, conducted and closed; and
WHEREAS, the Common Council believes it is in the best interest of the City that the Territory be annexed into the City.
NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SCOTTSBURG; AS FOLLOWS:
Section 1. The Territory is hereby annexed into the City.
Section 2. The Territory is assigned to Council District No. 1.
Section 3. The Clerk Treasurer of the City is hereby ordered to publish this Ordinance in the manner prescribed by Indiana Code 5-3-1.
Section 4. If no appeal of the annexation contemplated by this Ordinance has been filed pursuant to Indiana Code 36-4-3-15.5 within thirty (30) days after adoption of this Ordinance, the Clerk-Treasurer is hereby authorized and directed to: (A) file a copy of this Ordinance with (i) the Scott County Auditor; (ii) the Scott Circuit Court Clerk; (iii) the Scott County Board of Registration; (iv) the Office of the Indiana Secretary of State; and (v) the office of census data established by Indiana Code 2-5-1.1-12.2; and (B) record a copy of this Ordinance in the office of the Recorder of Scott County, Indiana.
Section 5. This Ordinance shall be in full force and effect from and after its adoption, publication in accordance with Indiana Code 5-3-1, and filing and recording in compliance with Indiana Code 36-4-3-
22(a).

Notice to Public of No Significant Impact on the Environment and Notice to Public of Request for Release of Funds

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about February 22, 2019, the Scott County Commissioners will request the release of federal funds from the Indiana Office of Community and Rural Affairs (OCRA) for Community Development Block Grant Funds from the State of Indiana under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383) for the following project:
LifeSpring Public Facility Building
The proposed project will include the acquisition and renovation of the former New Hope Building at 2277 W. Frontage Road in Austin. The facility will be renovated to accommodate a medical facility for LifeSpring Health Systems. The renovations will require structural elements such as drywall and studs, mechanical, electrical, HVAC, plumbing elements, and minimal site work such as parking lot repair.
Finding of No Significant Impact
It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above named Scott County Commissioners have decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (P.L. 91-190). The reasons for such decision not to prepare such statement are as follows:
All preliminary environmental reviews by state and county agencies indicated that the proposed project would not endanger the environment under any capacity.
An Environmental Review Record regarding the proposed project has been made by the above named Scott County Commissioners which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required. This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at the Scott County Government Building between the hours of 8:00 A.M. and 4:30 P.M., Monday through Friday. No further environmental review of such project is proposed to be conducted prior to the request for release of funds.
Public Comments of Findings
All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for consideration by the Scott County Commissioners to the Scott County Courthouse, 1 E. McClain Ave. #140, Scottsburg, Indiana 47170. Such written comments should be received by February 21, 2019. All such comments so received will be considered and the Scott County Commissioners will not request the release of federal funds or take any administrative action on the proposed project prior to the date specified in the preceding sentences.
Release of Funds
The Scott County Commissioners will undertake the project described above with Community Development Block Grant funds from the State of Indiana under Title I of the Housing and Community Development Act of 1974. The Scott County Commissioners are certifying to the State that the Scott County Commissioners and Robert Tobias, in his official capacity as President, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval the Scott County Commissioners may use the Block Grant funds and the State will have satisfied its responsibilities under the National Environmental Policy Act of 1969.
Objections to State Release of Funds
The State will accept an objection to its approval only if it is on one of the following basis: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by the State; or (b) that the applicant’s environmental review record for the project indicated omission of a required review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to the OCRA, Environmental Specialist, One North Capitol, Suite 600, Indianapolis, Indiana 46204-2027.
Objections to the release of funds on basis other that those stated above will not be considered by the State. No objections received after March 10, 2019 will be considered by the State.

Pursuant to the laws of the Indiana General Assembly and by resolution of the Jackson County Commissioners, notice is hereby given that the following described tracts or items of real property are listed for sale for delinquent taxes and / or special assessments.
The minimum sale prices listed below are less than the minimum sale prices when offered in the immediately preceding county tax sale held under Section 5 of IC 6-1.1-24 and include all fees and expenses of the county directly attributable to the Commissioners’ Certificate Sale. Pursuant to IC 6-1.1-24-5.1, a business entity that seeks to register to bid in an Indiana Commissioners’ Certificate Sale must provide to the county treasurer, a Certificate of Authority from, or proof of registration with the Secretary of State.
Pursuant to IC 6-1.1-24-3(e), property descriptions may be omitted for properties appearing on the certified list in consecutive years. A complete property list may be obtained at www.sriservices.com or in an alternative form upon request.
A person redeeming each tract or item of real property after the sale of the certificate must pay: (A) the amount of the minimum bid under Section 5 of IC 6-1.1-24 for which the tract or item of real property was last offered for sale; (B) ten percent (10%) of the amount for which the certificate is sold; (C) the attorney’s fees and costs of giving notice under IC 6-1.1-25-4.5; (D) the costs of a title search or of examining and updating the abstract of title for the tract or item of real property; (E) all taxes and special assessments on the tract or item of real property paid by the purchaser after the sale of the certificate plus interest at the rate of ten percent (10%) per annum on the amount of taxes and special assessments paid by the purchaser on the redeemed property; and (F), all costs of sale, advertising costs, and other expenses of the county directly attributable to the sale of the certificate.
If the certificate is sold for an amount more than the minimum bid under Section 5 of IC 6-1.1-24 for which the tract or item of real property was last offered for sale and the property is not redeemed, the owner of record of the tract or item of real property who is divested of ownership at the time the tax deed is issued may have a right to the tax sale surplus.
Indiana law prohibits a person who owes delinquent taxes, special assessments, penalties, interest, or costs directly attributable to a prior tax sale, from purchasing tracts or items of real property at a tax sale. Prior to bidding at a tax sale, each bidder must affirm under the penalties for perjury that he or she does not owe delinquent taxes, special assessments, penalties, interest, costs directly attributable to a prior tax sale, amounts from a final adjudication in favor of a political subdivision in this county, any civil penalties imposed for the violation of a building code or ordinance of this county, or any civil penalties imposed by a health department in this county. Further, each bidder must acknowledge that any successful bid made in violation of the above statement is subject to forfeiture. In the event of forfeiture, the bid amount shall be applied to the delinquent taxes, special assessments, penalties, interest, costs, judgments, or civil penalties of the ineligible bidder, and a certificate will be issued to the county executive.
The Commissioners specifically reserve the right to withhold from the sale any parcel which has been listed in error, or which otherwise becomes ineligible for sale either prior to the start or during the duration of the auction.
