Crothersville Dog & Cat Control Ordinance
ORDINANCE NO. 2014 – 4
 “An Ordinance Regulating Control of Dogs and Cats in the Town of Crothersville, Indiana.”
WHEREAS, The Code of the Town of Crothersville, Indiana does not currently include specific standards for the humane treatment of dogs and cats; and
WHEREAS, It is in the best interest of the Town of Crothersville, Indiana to address the issue of dogs and cats running at large.
NOW, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF CROTHERSVILLE, INDIANA:
Section 1:

  1. General requirements.

All dogs and cats shall be kept under restraint.

  1. Dogs and cats in heat.

Every female dogs and cats in heat shall be confined in a building or secure enclosure in such a manner that the animal cannot come into contact with a male animal of the same species except for planned breeding.

  1. Violations.
    1. Any animal control officer may issue to any person in violation of this ordinance a notice of ordinance violation. The penalty established shall be paid to the Clerk-Treasurer within seventy-two (72) hours in full satisfaction of the assessed penalty. In the event that such payment is not made within the period prescribed, proceedings shall be filed in the Jackson Superior Court 1.
    2. Persons who violate any provision of this chapter shall be subjected to the following fine:
    3. Failure to restrain, first offense: $25.00. Fines for each subsequent offense within twelve (12) consecutive months for first offense increase in increments of $25.00 per offense.
    4. Failure to restrain vicious dog or potentially dangerous dog, first offense $100.00. Fines for each subsequent offense within twelve (12) consecutive months of first offense are $100.00 per offense.
    5. Failure to post warning signs, if required to do so by the Police Chief, or his designee, for potentially dangerous and/or vicious dogs and cats $50.00.
    6. Failure to notify the Police Chief of change of status for potentially dangerous and/or vicious dogs and cats $50.00.
    7. Failure to comply with any portion of the foregoing not previously addressed shall result in a $100.00 fine.

Section 2:

  1. Public nuisance prohibited.

Owners/guardians of dogs and cats shall exercise due care and control of his dog(s) to prevent them from becoming a public nuisance.

  1. Violations.
    1. Any Town law enforcement officer may issue to any person in violation of this ordinance a notice of ordinance violation. The penalty shall be paid to the Ordinance Violations Clerk within seventy-two (72) hours in full satisfaction of the assessed penalty. In the event that such payment is not made within the period prescribed, proceedings shall be filed in Jackson Superior Court 1.
    2. Persons who violate any provision of this chapter shall be subject to a fine of fifty dollars ($50.00) for the first offense, with the fine of each subsequent offense of this chapter increasing by an increment of fifty dollars ($50.00).

 
Section 3:

  1. Dogs and cats to be impounded.
    1. At-large dogs and cats, nuisance dogs and cats, dogs and cats suspected of being neglected, subjected to cruelty or abandoned, and dogs and cats which have bitten persons or other animals may be taken by law enforcement or animal control officers and impounded by the Town of Crothersville.
    2. In lieu of impounding a dog which is at large or a public nuisance, the law enforcement officer or animal control officer may issue to the known owner/guardian of such dog a notice of ordinance violation and may return the dog to the owner/guardian’s property if the animal can be secured safely.
  2. Notice of impoundment.
    1. If the owner/guardian of an impounded dog can be identified, the Town employee or law enforcement officer or his/her designees shall immediately upon impoundment notify the owner/guardian by telephone or mail.
    2. Dogs and cats whose owner/guardians are not identifiable or cannot be notified after reasonable effort shall be held for three (3) calendar days from the date of impoundment, not counting officially recognized holidays, shall become the property of the Town.
    3. Dogs and cats whose owner/guardians have been notified and who do not reclaim their animals within three (3) day period shall also become the property of the Town.

i.     Any stray dogs and cats shall become the property of the Town and may be placed for adoption or humanely euthanized if not claimed by the owner/guardian within three (3) days of impoundment.
ii.     Any stray dogs and cats found with severe medical conditions and/or injuries shall be assessed by a veterinarian, as quickly as possible. Whenever possible, humane care will be provided in order to allow the dog to remain comfortable for the duration of the three (3) day period. However, when a dog’s injuries or illnesses are so severe such that the dog cannot be maintained in a comfortable fashion, the dog may be euthanized prior to the end of the stay period.
iii.     Any medical expenses incurred while the dog is in the care of the Town shall be the responsibility of the owner/guardian of the dog should be the owner/guardian be identified.
iv.     Dogs and cats that are the property of the Town may be placed for adoption or humanely euthanized.

  1. Impounded animals—Reclamation
    1. An owner/guardian reclaiming an impounded animal shall pay a board fees as follows:

i.     Dog, impounded for 1-5 days $10.00 per day
ii.     Dog, impounded for 6 or more days $20.00 per day

  1. The Town of Crothersville may agree to waive same or all of its fines and fees at the discretion of the Police Chief if the owner/guardian of an unaltered dog agrees to have the dog spayed or neutered as a condition of its release.
  2. A person may reclaim a dog in the custody of the Town of Crothersville or Jackson County Animal Control Officer upon providing the following:

i.     Proof of ownership
ii.     Identification such as a driver’s license,
iii.     Payment of redemption fee and any other service, medical fees, as approved by the Police Chief.
 
Section 4: Funds generated by fines and penalties under this ordinance shall be deposited into the Animal Wasting and Board Fund.
 
Section 5: All prior ordinances or parts thereof inconsistent with any provision of this ordinance are hereby repealed.
Section 6: This ordinance shall be in full force and effect from and after its passage, and publication, all as by law provided.
