After the noon deadline last Friday to file for school board, some races developed with first time candidates for area education boards. School board races will be voted on in the Nov. 3, general election. In Crothersville, incumbents Dale Schmelze and B.J. McLain opted not to seek re-election. In District 1, the northern part of Vernon Township, Chad Ord of 11905 E 50 N and Jerad Sporleder of 422 N US 31 will vie for that district’s school board representative. In District 4, representing the west side of Crothersville, John Riley of 301 W. Howard Street will run opposed. All three incumbents in Scott County School District 1 filed for re-election. Seeking re-election to another term are Ron Atkins, Darlene Hall and Joie Bukowski and new-comer but familiar name to Austin education David F. Deaton is seeking one of the at-large school board seats. Jennings Township voters will vote for three in the Nov. 3 election. In Scott County School District 2, no incumbent filed to run for re-election to the school board. Voters will be given three choices for the Finley Township school board seat: Sarah K. Broady of 4916 S. Boatman Road, Kenneth D. McMichael of 2259 W. Craig Road and Jean M. Robbins of 3278 W. Lake Road W. Christy Roberts currently holds that school board seat. William J. Best of 4393 E. State Road 256 was the lone filer seeking the Johnson Township school board seat. Josh Mays currently holds that school board seat. It will be a three-way race for the Vienna Township seat representing residents inside the city limits of Scottsburg. Lee A. Hahn of 1236 W. Woodstone Ct, Holly L. Peacock-Armstrong of 412 N. Meridian Street and Rick Zollman of 448 S. Bond are contesting the seat currently held by Ron Moore.
According to a legal notice ad beginning on page 3 of print edition of the Crothersville Times and found under Public Notices in our online edition, there are 80 parcels of property with delinquent taxes that could be sold at an auction at the Scott County courthouse on Tuesday, Oct. 6, beginning at 10 a.m. Real estate on which property taxes have not been paid for 18 months are eligible to be offered for sale by the county for back taxes. During the October auction, properties will be offered for late taxes and auction fees with a minimum beginning bid. After the auction, the property owners have up to a year to ‘redeem’ or pay the successful bidder for his bid plus interest, according to Scott County Auditor Tammy Johnson. In the first six months, to redeem a property an owner must pay 10% of the minimum bid and 5% per annum for any bid amount over the minimum bid. After six months, the interest goes to 15%. In this day of less than 1% savings accounts and 1.5% CD’s, many investors participate in tax sales as a way to earn better returns on their money. Residents interested in bidding on the tax sale should register online at http://legacy.sri-taxsale.com/Tax/Indiana/Registration/. Bidders should arrive the morning of the tax sale at least 30 minutes before the beginning time to be assured to receive your bid number before the start of the sale. Bidders should bring their registration form and W9 form with you the morning of the tax sale. You will be able to print these forms from the registration web site, according to Scott County Treasurer Sheryl Jent. Residents with property on the delinquent property tax list have until the day of the auction to pay the back taxes and have the property removed from the auction’s sale list.
Two people were arrested in separate incidents in Crothersville on Sunday, Aug. 16. According to a Jackson County Sheriff news release, the department received a complaint to two people apparently passed out in the parking lot of the Dollar General Store on US 31 in Crothersville. Deputies Zach Elliott and Clint Burcham arrived to investigate. After Jackson County EMS got the occupants of the vehicle to respond, the occupants gave their consent to deputies to search the vehicle. Brittany Renee Justice, 28, with no address told officers that everything in the vehicle was hers. During their search deputies found several syringes in the vehicle. After deputies transported Justice to Jackson County Jail, methamphetamine was found on the woman. Justice was jailed for possession of methamphetamine and possession of syringe. She remains in jail on a $1,005 bond. The passenger in the vehicle was released at the scene. A short time later, as Elliott was on patrol in Crothersville, he made a traffic stop at 1:45 p.m. in the 100 block of West Howard Street on a red Chevrolet automobile. Nathan Alan Rucker, 28, of Austin was driving the vehicle but did not have a driver’s license. During his investigation, Elliott located methamphetamine, a syringe, and drug paraphernalia in the car. According to the officer, Rucker began to make death threats to the deputy after being told he was being arrested. Rucker was booked into Jackson County Jail on charges of possession of methamphetamine, possession of a syringe, possession of paraphernalia, and intimidation. He remains in jail on a $1,505 bond.
On Thursday, August 13, Scott County Sheriff’s Deputy Johnney Coomer attempted to make a traffic stop in rural Scott County but the vehicle fled from the officer stopping at a residence on Newman Road. As the deputy attempted to question the driver there was a scuffle. Coomer’s questioning led to the arrest of Timothy Anderson, 47, of Lexington for resisting law enforcement with a vehicle, battery resulting in injury to a police officer, possession of methamphetamine, possession of a syringe, unlawful possession of a legend drug, possession of a controlled substance, possession of paraphernalia, maintaining a common nuisance, and possession of marijuana. The next day, Scott County Detectives and Deputies served a drug related search warrant at 237 W. Owen Street in Scottsburg. The search warrant stemmed from an ongoing investigation by the Scott County Detectives, Sheriff Jerry Goodin said. As a result of the search warrant two people were arrested and two people were cited into court. Deborah Smith, 57, of Scottsburg was arrested for maintaining a common nuisance and neglect of a dependent. Daniel Smith, 35, of Scottsburg was arrested for a warrant for two counts of dealing in methamphetamine. He later was also charged with trafficking with an inmate and possession of a controlled substance. The Smiths were incarcerated in Scott County Jail. There were two others at the residence when police served the search warrant. Hailey Lowry, 30, of Scottsburg was cited into court and released on the charge of visiting a common nuisance. Gregory Dilger, 44, of Scottsburg was cited into court and released on the charge of possession of paraphernalia.
The Indiana Court of Appeals last Tuesday, Aug. 18, upheld the Scott County convictions of Robert F. Petty for voluntary manslaughter, removal of body from scene, and obstruction of justice, according to Scott County Prosecutor Chris A. Owens. “This assures that Mr. Petty will serve his 56 year prison sentence originally ordered in this matter,” said Owens. In 2013, Robert Petty was convicted and sentenced to prison for 56 years for killing Nina Keown and taking steps to attempt to cover up his crime, Owens related. In 2019, Petty filed a motion in an attempt to have his conviction and sentence set aside under a process called Post-Conviction Relief. “However, in February 2020, our office successfully fought in Scott Circuit Court to make sure Petty’s conviction was secure and that he remain in prison to serve out his entire sentence,” said Owens. “(Tuesday), the Indiana Court of Appeals ruled that the conviction will stand and that Mr. Petty will have to serve out the sentence as previously ordered.” The matter was handled at the appellate court level by the Indiana Attorney General’s Office. “Deputy Attorney General, Evan Comer did an excellent job fighting to uphold the work of the Scott County Prosecutor’s Office. “Unfortunately, cases like this never seem to go away,” said Owens. “It has been several long years, but I hope that the decision by the Indiana Court of Appeals affirming our work here in Scott County finally brings some closure for Nina’s family and friends.”

As a part of said transaction, Owners hired surveyor Mark Gardner.
Upon doing his site work, Mr. Gardner discover a small section of real estate that he believes was intended to be transferred along with the above-described parcel in 1980, but was mistakenly not transferred, and has not been since, resulting now in a 0.134 acre of real estate that is not currently accounted for in any adjoiner’s deed.
Mr. Gardner set stakes identifying the 0.134-acre parcel in October of 2019 and prepared a plat map of said parcel. Owners assert that they hold fee simple title to the Non-deeded Parcel against any and all persons, including the Defendants.
There is a cloud upon the title to the Non-deeded Parcel because the chain of title does not account for said parcel, and the purpose of this Complaint is to quiet title to the Non-deeded Parcel as against the world.
Plaintiffs have named as Defendants all persons within his knowledge through whom any hostile claim might be asserted against the Plaintiffs or Plaintiffs’ future ownership claim in the Non-deeded Parcel.
The Plaintiffs’ interest in the Non-deeded Parcel is superior to any claims of the Defendants and any or all other persons claiming an interest in and to said real estate.
The Defendants may claim some title, lien, right, or interest in the Non-deeded Parcel adverse to the Plaintiffs. The claims of the Defendants are without any right whatsoever and said Defendants have no estate, right, title, lien, or interest in or to said Non-deeded Parcel or any part thereof.
